July 2013 — OCIDA-7-2-13-Governance-Minutes =========================================== Onondaga County Industrial Development Agency Governance Committee Meeting Minutes July 2, 2013 A Governance Committee meeting of the Onondaga County Industrial Development Agency was held on Tuesday, July 2, 2013 at the 333 West Washington Street, Syracuse, New York in the large conference room on the first floor. Chairperson Donna DeSiato called the meeting to order at 7:52 am with the following: PRESENT: Donna DeSiato Victor Ianno DELAYED: Jessica Crawford ALSO PRESENT: Mary Beth Primo, OCIDA, Executive Director Kristi Smiley, OCIDA, Secretary & Treasurer Karen Doster, Recording Secretary, Agency Carolyn May, Office of Economic Development Devon Knapp, Office of Economic Development Tony Rivizzigno, Gilberti Law Firm APPROVAL OF GOVERNANCE COMMITTEE MEETING MINUTES —- DECEMBER 11, 2012 Upon a motion by Donna DeSiato, seconded by Victor Ianno, the OCIDA Board approved the Governance Committee regular meeting minutes of December 11, 2012. Motion was carried. REVIEW PROPOSED REVISIONS TO OCIDA’S UNIFORM TAX EXEMPTION POLICY Mary Beth Primo stated that the goals of the UTEP revision were to make the policy more competitive, clear and easier to understand. She stated the staff reviewed policies from around the state. She stated the revised policy allows the Board to be competitive and flexible. She stated that staff also worked to make it responsible to the municipalities and school districts. She stated that the most robust and flexible would be the enhanced PILOT and this would allow OCIDA to provide up to a 20 year PILOT with up to 100% exemption for the entire term. She stated the idea is that this would be available to substantial projects and “substantial” would be determined by the Board on a by case basis. The Committee and staff discussed the proposed schedule. (Jessica Crawford arrived at meeting.) Mary Beth Primo stated that the revised basic schedule would replace the 485b PILOT Schedule that the Agency offers currently as the standard PILOT. The Committee and staff discussed the proposed Basic PILOT schedule. Mary Beth Primo stated that the community benefit schedule would be an incentive to reward adaptive reuse, brownfield development and green development projects using the Basic PILOT formula and adding an additional incentive. The Committee and staff discussed the Community Benefit PILOT schedule. Mary Beth Primo then explained the proposed revisions to the Recapture Policy and the thought behind making it more aggressive. Mary Beth Primo described when the recapture would kick in and explained the new recapture schedule She stated that she thinks it is consistent and complimentary to the fact that we are making our PILOT so much more robust. Upon a motion by Donna DeSiato, seconded by Victor Ianno, the Committtee approved a resolution recommending to the full Board adoption of the revised UTEP with the amendment to the community benefit incentive to be 12 years. Motion was carried. REVIEW PROPOSED REVISIONS TO OCIDA’S FEE STRUCTURE Mary Beth Primo stated that the current fee is $1,000 and it had been for many years $500. She stated that it has been $1,000 for about two years. Mary Beth Primo asked the Governance Committee if they would like to lower the application fee to $500. The Governance Committee agreed. Mary Beth Primo stated that currently the fee for manufacturing projects under $10,000,000 is %4 of 1%. She explained that if the project receives a PILOT then the fee is increased by 4%. She stated that with the revised fee schedule the ‘4% for a PILOT will not be added. She stated that a fee for a manufacturing project under $10,000,000 will be %4 of 1% whether they receive a PILOT or not. She stated that all other projects will be 1%. The Committee and staff discussed project fees. Upon a motion by Donna DeSiato, seconded by Jessica Crawford, the OCIDA Board approved a resolution recommending that the full Board adopt the revised fee structure. Motion was carried. The Board then discussed attorney fees with counsel. Upon a motion by Jessica Crawford, seconded by Donna DeSiato, the OCIDA Board adjourned wal ope ~~ Kfisti Smiley, ay the meeting at 8:36 am.
