TOWN OF CLAY
    LOCAL LAW NO. 1 OF THE YEAR 2014 TO AMEND CHAPTER 230
    entitled "ZONING," Section 230-17; Industrial Districts, of the Code of the
    Town of Clay.
    IT IS ENACTED by the Town Board of the Town of Clay, County of Onondaga
    as follows:
    SECTION 1. Amending Chapter 230-17 entitled "Industrial Districts," by
    amending Section 230-17C (2) adding a new category entitled MOTOR
    VEHICLE STORAGE to subparagraph (e) Town Board Special Permit
    approval and optional advisory referral to the Planning Board: and to
    renumber said categories accordingly to the Code of the Town of Clay.
June 16, 2014 called public hearing for proposed local law for July 21, 2014 commencing at 7:38 P.M.,
Notice of public hearing published in the Post Standard on July 10, 2014.

§ 230- 17                                          CLAY CODE                                             §230-17
C.    I - l Industrial 1 District.
(1)   I-l intent. The purpose of the I-l District is to promote and accommodate those kinds of
      industrial uses that provide the logistical assembly, shipping, storage, servicing, or similar
      support for retail or other business uses. Nonindustrial uses are limited to large office buildings
      or land uses that are essential to the district. These uses are expected to conduct all operations
      in one or more buildings, organized in a well-planned setting within enclosed structures in a
      clean, quiet manner that results in little or no exterior evidence of industrial activity and,
      therefore, can be compatible to nearby commercial or residential areas.
(2)   Uses allowed. In addition to the following requirements, all land uses and/or structures shall
      comply with all relevant local, county, state or federal permits and regulations prior to or as a
      condition of final zoning approval
      (a) Department of Planning and Development issuing a building pennit: (reserved)

Alteration of I-l to allow for MOTOR VEHICLE STORAGE with a Town Board
Special Permit.
To accommodate a request to change the zoning code that would permit Motor Vehicle
Storage in the I - l zoning district, the existing definition would have to be added to
Sections 230-17C(2)(e)[7] with a Town Board Special Permit.
This change will accommodate a few of the vehicle towing service businesses that are
currently located within the I-1 zoning district.
MOTOR VEHICLE STORAGE - A facility occupying land, structures and/or buildings
for the temporary controlled storage of operable motor vehicles. The addition or removal
of any vehicle shall be subject to the control of the facility management. The use may
contain space for offices and vehicles directly related to the operation. Examples include:
impound yards, towing services, vehicle holding yards or similar facilities storing
vehicles for legal or financial reasons. This use excludes routine public parking, public
garages, the storage of disabled or junk motor vehicles and/or "motor vehicle sales,
service, rental" (as defined).
