NOTICE IS HEREBY GIVEN that the Town Board of the Town of Clay will hold a Public Hearing on October 19 , 2026 , commencing at 7:47 P.M ., local time, to consider LOCAL LAW NO. 11 OF THE YEAR 2026 pursuant to Section 487 of the Real Property Tax Law (RPTL) to “opt out” of allowing real property tax exemptions pursuant to Section 487 of the PRTL and declare Battery Energy Storage Systems fully taxable in the Town of Clay.
At such time all persons interested will be given an opportunity to be heard.

This notice announces a public hearing for Local Law No. 11 of 2026, which proposes to opt out of real property tax exemptions for Battery Energy Storage Systems and declare them fully taxable. The Town Board passed a resolution on October 5, 2026, to hold this hearing. A prior Local Law 5 of 2026 was filed to create guidelines for Battery Energy Storage Systems. Local Law 5 of 2020 was also filed to opt out of property tax exemptions for solar and wind energy systems.
