The meeting was called to order by Supervisor Ulatowski at 7:30 P.M. All present joined in the Pledge of Allegiance.

Approval of Minutes:

Councilor Hess made a motion to approve the minutes of the August 15, 2022 Town

Board meeting. Motion was seconded by Councilor Meaker.

Ayes – 5 and Noes – 0. Motion carried. Councilor Bick thanked the Clerk for the

thoroughness of the minutes.

Cancellation and/or requested adjournments.

Supervisor Ulatowski said that item number 10 on the agenda (release of securities for Orange Commons will not be heard pending further research.

REGULAR MEETING OF THE TOWN BOARD – September 7, 2022

Town of Clay

2 SEWER LATERAL CONNECTION – MICHAEL A. & MARY ELLEN GILBERT:

Councilor Hess moved the adoption of a resolution authorizing a SANITARY

SEWER LATERAL CONNECTION, pursuant to the written request of Michael A. & Mary Ellen Gilbert (property owners), Tax Map No. 025-01-14.1, to the existing low pressure force main located along Bonstead Road. The associated construction will be at no cost to the Town of Clay. The property is located within the Horseshoe Island sewer district. The property owner agrees to pay all costs (Town and private) associated with the sanitary sewer lateral connection as well as the Town of Clay Operation and Maintenance charges annually assessed for one unit (residential use) and the County Sanitary District charges. The property owner further agrees to pay all annual Town and County charges thereafter. Motion was seconded by Councilor Bick.

Ayes – 5 and Noes – 0. Motion carried.

APPOINTMENT- BOARD of ASSESSMENT REVIEW:

Councilor Hess moved the adoption of a resolution appointing Anne Stenham to the

BOARD of ASSESMENT REVIEW for a term of five years. Said term to expire September 30, 2027. Motion was seconded by Councilor Bick.

Ayes – 5 and Noes – 0. Motion carried.

Project/Securities (posting) – CLAY MARKETPLACE PDD f/k/a HENRY CLAY COMMONS:

Councilor Meaker moved the adoption of a resolution that the Town of Clay having

conducted public hearings to consider the construction and acquisition of sewer facilities located within the CLAY MARKETPLACE PDD f/k/a HENRY CLAY COMMONS, (Newbury Woods Sewer District, Contract No. 1) and the construction of said facilities having been completed in accordance with the Plans and Specifications thereof; The Town Engineers having certified that the facilities have been satisfactorily completed and that the developer post the following security as shown under correspondence by the Town Engineers’ under date of September 2, 2022: Maintenance Guarantee - $60,000 ($60,000 Sewer); and any other unpaid fees that may be owed by the Town of Clay for engineering, legal and/or administrative fees; and further contingent upon the developer having complied with all the requirements set forth in an Agreement between the Town of Clay and GROUP ONE DEVELOPMENT, LLC, that the Town accept title to such facilities. Motion was seconded by Councilor Young. Councilor Bick asked when the public hearing was held. Ron DeTota stated that it was roughly 10 years ago. Councilor Hess said it was 12-13 years ago.

Ayes – 4 and Noes – 1. Motion carried. Councilor Bick voting no.

REGULAR MEETING OF THE TOWN BOARD – September 7, 2022

3 Project/Easements – CLAY MARKETPLACE PDD f/k/a HENRY CLAY COMMONS:

Councilor Meaker moved the adoption of a resolution accepting easements for sewer

facilities located within CLAY MARKETPLACE PDD f/k/a HENRY CLAY COMMONS, (Newbury Woods Sewer District, Contract No. 1) all as shown on a Right-Of-Way map prepared by Ianuzi & Romans Land Surveying, P.C., dated April 12, 2022. Motion was seconded by Councilor Young.

Ayes – 4 and Noes – 1. Motion carried. Councilor Bick voting no.

Release of Securities – ORANGE COMMONS DEVELOPMENT:

No Action

The meeting was adjourned at 7:36 P.M. upon motion by Councilor Young and seconded by Councilor Bick.
