Councilor Hess made a motion to approve the minutes of the November 3, 2021

Town Board meeting. Motion was seconded by Councilor Hall.

REGULAR MEETING OF THE TOWN BOARD – November 15, 2021 Town of Clay

Councilor Hess made a motion to adjourn the public hearing to January 19 at 7:35

P.M. local time. Motion was seconded by Councilor Bick.

Special Permit (CPH) - Town Board Case # 1169 - CLASSY CHASSY/KIMBROOK ROUTE 31 DEVELOPMENT, LLC:

Councilor Meaker moved the adoption of a resolution calling a public hearing

December 6, 2021, commencing at 7:35 P.M., local time, to consider the application of CLASSY CHASSY/KIMBROOK ROUTE 31 DEVELOPMENT, LLC., FOR A SPECIAL PERMIT pursuant to Section 230-16C.(2)(e)[3] to allow for an Automobile Car Wash on +/-1.50 acres of land, located at 3610 NYS Route 31, Tax Map No. 052.-02-11.6. Motion was seconded by Councilor Young.

Special Permit (CPH) - Town Board Case # 1168 – CLAY QUAD WEST, LLC:

Councilor Hall moved the adoption of a resolution calling a public hearing

December 6, 2021, commencing at 7:38 P.M., local time, to consider the application of CLAY QUAD WEST, LLC./KIA MATTHEWS, FOR A SPECIAL PERMIT pursuant to Section 230-16C.(2)(e)[4]+[5] to allow for an expansion of existing special permit use of motor vehicle service and sales, located at 3885 STATE ROUTE 31, Tax Map No. 021.-01-03.1. Motion was seconded by Councilor Hess.

Ayes – 7 and Noes – 0. Motion Carried.

Appointment (A) - CLAY VOLUNTEER FIRE DEPARTMENT, INC.:

Councilor Young moved the adoption of a resolution approving the

appointment of ANDREW GILBERT as a member of the CLAY VOLUNTEER FIRE DEPARTMENT, INC. Motion was seconded by Councilor Bick.

Ayes – 7 and Noes – 0. Motion Carried.

Agreement (A) – New York State Department of Transportation:

Councilor Pleskach moved the adoption of a resolution approving a Highway Work

Permit between the Town of Clay and the New York State Department of Transportation, whereas said Permit is issued and used by the Town of Clay in REGULAR MEETING OF THE TOWN BOARD – November 15, 2021 Town of Clay

3 connection with work affecting the Right-of-Way of a State Highway; pursuant to Article 3, Section 52 of State Highway Law and Section 1220-c of the Vehicle and Traffic Law; and further authorizing the Supervisor to execute the necessary documents therefore. Motion was seconded by Councilor Bick.

Local Law No. 2 of the Year 2021(adding a new chapter) SOLAR ENERGY SYSTEMS (CPH):

Whereas, in recent years the Town of Clay has received interest from

commercial solar generating companies seeking to develop commercial solar arrays in the Town, and,

Whereas, the Town Board believed the Town and its residents would benefit

from a study of solar development issues and potential laws to address those issues, and,

Whereas, the Town of Clay duly enacted and later modified and extended a

Moratorium against the consideration of new commercial solar generating farm applications in the Town and appointed a team to consider and write a new Code Section addressing the issues, WE HEREBY NOW,

Move the adoption of a resolution calling a Public Hearing on December 6th, 2021 commencing at 7:41 P.M., local time to consider a new Local Law No. 2 of the Year 2021, enacting a new Town Code section titles Solar Energy Systems. The purpose of this new Code Section is to protect the public health, safety and welfare of the Town residents by creating and enforcing regulation for the installation and use of solar energy generating systems in the Town. A copy of the draft proposed Local Law Code Section has been provided to the Town Clerk and will be posted on the Town Website. Motion was seconded by Councilor Hall.
