The meeting was called to order by Supervisor Ulatowski at 7:30 P.M. All present joined in the Pledge of Allegiance.
Approval of Minutes:
Councilor Bick made a motion to approve the minutes of the OCTOBER 18, 2021
meeting. Motion was seconded by Councilor Hall.
Ayes – 6 and Noes – 0. Motion carried. Councilor Hess abstained due to his absence
at that meeting.
Cancellation and/or requested adjournments.
Supervisor Ulatowski explained that item numbered 10 on the agenda would not be heard.
Correspondence:
Ute Wood of Orange Commons asked for an update on the Welcome to the Town of Clay signs. Supervisor Ulatowski explained that there is a delay due to an emergency on Gaskin Road and the necessity for Dig Safely to approve the sites for the signs.

REGULAR MEETING:
Paula Caron, Deputy Comptroller was present to speak on behalf of the various budgets. Supervisor Ulatowski began by reading the 2022 Budget Message again. There will be a 0% increase for the 2022 year. He thanked the Town Board and Town Employees for their hard work and diligence in keeping the budget low. Budget (PH) – 2022 SPECIAL DISTRICTS BUDGET for the TOWN OF CLAY:
A public hearing to consider the adoption of the proposed 2022 Special Districts Budget for the Town of Clay was opened by the Supervisor; proof of publication and posting was furnished by the Town Clerk.
Deputy Comptroller Caron gave a brief presentation, going through each of the budgets. She explained that the Special Districts Budget addresses items such as trash, brush, sewer and hydrants. They are going ahead with the proposed drainage updates and brush costs will increase 10%. However, the hydrants are paid off after 30 years.
There being no questions or comments, Supervisor Ulatowski closed the public hearing.
Budget (PH) – 2022 FIRE PROTECTION BUDGET for the TOWN OF CLAY:
A public hearing to consider the adoption of the proposed 2022 Fire Protection Budget for the Town of Clay was opened by the Supervisor; proof of publication and posting was furnished by the Town Clerk.
Deputy Comptroller Caron explained that there are 5 Volunteer Fire Departments covering the Town of Clay. The greatest cost associated with the Fire Departments is the Length of Service Awards Program (LOSAP), which provides Fire Fighters a small retirement incentive for participation in drills, training, calls etc. Supervisor Ulatowski added that the Fire Departments work conscientiously to stay below the Governors Tax Cap. He continued that they provide excellent service to the residents of the Town of Clay.
Councilor Pleskach asked if they need anything; Supervisor Ulatowski explained that he meets with them during the year to determine if they have what they need.

3 Budget (PH) – 2022 UNIFORM WATER BUDGET for the TOWN OF CLAY:
A public hearing to consider the adoption of the proposed 2022 Uniform Water Budget for the Town of Clay was opened by the Supervisor; proof of publication and posting was furnished by the Town Clerk.
Deputy Comptroller explained that the Town of Clay Water Department provides water to approximately 1/3 of the Town. The water is purchased from OCWA and sold to the residents at 2/3 of the cost OCWA charges direct customers. This area includes Bayberry and several of the apartment complexes. They have installed new meters for nearly 1/2 of the customers, providing more efficient reading of consumption.
There being no questions or comments, Supervisor Ulatowski closed the public hearing.
ADOPTION of the PROPOSED 2022 PRELIMINARY BUDGET FOR THE TOWN OF CLAY (PH):
A public hearing to consider the adoption of the proposed 2022 Preliminary Budget for the Town of Clay was opened by the Supervisor; proof of publication and posting was furnished by the Town Clerk.
The Supervisor reiterated that there will be no increase in the Town portion of the taxes and again the Town of Clay has provided a budget below the 2% Tax Cap.
There being no questions or comments, Supervisor Ulatowski closed the public hearing.
Special Permit (SEQR) - Town Board Case # 1164 - ANTHONY DANIELE, DANIELE FAMILY COMPANIES, LLC:
Supervisor Ulatowski said that the SEQR would not be heard, as it was a negative declaration at the August 16, 2021 hearing.
Special Permit (A) - Town Board Case # 1164 - ANTHONY DANIELE, DANIELE FAMILY COMPANIES, LLC:
Councilor Hall moved the adoption of a resolution approving the application of
SPECIAL PERMIT pursuant to Section 230-16B(2)(e)[3] allow for an Automobile Car Wash facility (Royal Car Wash), on land located at 7376 Oswego Road, Tax Map No. 104.-03-04.1. Motion was seconded by Councilor Young.

PRELIMINARY BUDGET as (proposed or modified), for the TOWN OF CLAY ANNUAL BUDGET for the fiscal year commencing January 1, 2022. Motion was seconded by Councilor Hess.

LIMIT ESTABLISHED IN GENERAL MUNICIPAL LAW SECTION 3-C (PH):
Councilor moved the adoption of a resolution (approving/denying) the proposed Local
Law to be entitled “LOCAL LAW NO. 1 OF THE YEAR 2021 TO OVERRIDE
SECTION 3-C” to the code of the Town of Clay.
Mobil Home License - 2022 (CPH):
Councilor Meaker moved the adoption of a resolution calling a public hearing
November 15, 2021, commencing at 7:35 P.M., local time, to consider the application of CASUAL ESTATES, LLC D/B/A MADISON VILLAGE MOBILE HOME COURT, for the renewal of its license for the year 2022. Motion was seconded by Councilor Pleskach.
Ayes – 7 and Noes – 0. Motion Carried.
BRUSH REMOVAL DISTRICT NOs. 2, 3 and 4:
Councilor Hess moved the adoption of a resolution awarding a contract for
DISTRICT NOs. 2, 3 and 4 within the Town of Clay to SUPERIOR WASTE for a period of 3 Years having a pick-up frequency of weekly being the low bid of $880,416.00; said amount being the lowest responsible bid, and further authorizing the Supervisor to execute any and all documents therefore. Motion was seconded by Councilor Bick.
Ayes – 7 and Noes – 0. Motion Carried.

Councilor Hess moved the adoption of a resolution awarding a contract for
DISTRICT NOs. 5, 7 and 8 within the Town of Clay to SUPERIOR WASTE for a period of 3 Years having a pick-up frequency of weekly being the low bid of $80,416.00; said amount being the lowest responsible bid, and further authorizing the Supervisor to execute any and all documents therefore. Motion was seconded by Councilor Bick.

6 Appointment (A) - CLAY VOLUNTEER FIRE DEPARTMENT, INC.:
Councilor Young moved the adoption of a resolution approving the appointment of
DENZEL HERNANDEZ as a member of the CLAY VOLUNTEER FIRE DEPARTMENT, INC. Motion was seconded by Councilor Hess.
Ayes – 7 and Noes – 0. Motion Carried.
The meeting was adjourned at 8:00 P.M. upon motion by Councilor Young and seconded by Councilor Meaker.
