The meeting was called to order by Supervisor Ulatowski at 7:30 P.M. All present joined in the Pledge of Allegiance.
Approval of Minutes:
Councilor Hess made a motion to approve the Minutes of the September 16, 2019
Regular Town Board Meeting and the September 30, 2019 Special Joint Meeting. Councilor Hall seconded the motion.

Supervisor Ulatowski said that item number 7 on the agenda will not be heard; the
applicant requested an adjournment. He added that the Highway Superintendent would not be available as planned due to a family emergency. Correspondence:

2 Supervisor Ulatowski asked if anyone wished to address the Town Board on anything not on the agenda.
A Richard Fernandez of 4181 Oakledge Drive said that he was not happy with repairs made to his road by the Highway Department and came out to speak to the Highway Superintendent. The Clerk took the information to give to the Highway Superintendent.
Town Clerk presents the 2020 TOWN OF CLAY TENTATIVE BUDGET to the Town Board Members pursuant to Town Law.

Councilor Hess made a motion to adjourn the public hearing (at the request of the
applicant) to October 21, 2019 at 7:47 P.M. Motion was seconded by Councilor Bick.

Appointment (A) – MOYERS CORNERS FIRE DEPARTMENT, INC:
Councilor Young moved the adoption of a resolution approving the appointment of
Donald Allen and Matthew Szatanek as volunteer members of the MOYERS CORNERS FIRE DEPARTMENT, INC. – STATION 1; Christopher Finn as a volunteer member of the MOYERS CORNERS FIRE DEPARTMENT, INC. – STATION 2; Marc Mullane, Daniel Smith and Austin Sculley as volunteer members of the MOYERS CORNERS FIRE DEPARTMENT, INC. – STATION 3; and Gary Piontkowski as a volunteer member of the MOYERS CORNERS FIRE DEPARTMENT, INC. – STATION 4. . Motion was seconded by Councilor Meaker.

Agreement (A) - OCWA Lease(s):
Councilor Hall moved the adoption of a resolution approving the renewal of OCWA
Lease(s) and Operations within the Town of Clay for the Clay Consolidated Water District, Maple Road Water Supply District, Gaskin Road Water District Improvement No. 2 and Water Sale Agreements, and authorizing the REGULAR MEETING OF THE TOWN BOARD – October 7th, 2019 Town of Clay
3 Supervisor to execute the necessary documents therefore. Motion was seconded by Councilor Hess.

SPECIAL PERMIT (CPH) – TOWN BOARD CASE # 1144 - BORREGO SOLAR SYSTEMS, INC. AND DONALD J. GABOR:
Councilor Bick moved the adoption of a resolution calling a public hearing October
21, 2019, commencing at 7:35 P.M., local time, to consider the application of
UTILITY SUBSTATION SPECIAL PERMIT pursuant to Section 230-27 I. (2) (E) to allow for solar development located at 8150 Morgan Road, Tax Map No. 070.-01-07.1. Motion was seconded by Councilor Hess.

SPECIAL PERMIT (CPH) – TOWN BOARD CASE # 1145 - OMNI NAVITAS HOLDINGS, LLC AND GEORGE YOUNG:
Councilor Pleskach moved the adoption of a resolution calling a public hearing
October 21, 2019, commencing at 7:38 P.M., local time, to consider the application of OMNI NAVITAS HOLDINGS, LLC AND GEORGE YOUNG FOR A UTILITY SUBSTATION SPECIAL PERMIT pursuant to Section 230-27 I. (2) (E) to allow for a solar farm located at 9177 Caughdenoy Road, Tax Map No. 043.-01-01.0. Motion was seconded by Councilor Hess.

LOCAL LAW No. 3 of 2019 (CPH) - TO OVERRIDE THE TAX LEVY LIMIT ESTABLISHED IN GENERAL MUNICIPAL LAW SECTION 3-C:
Councilor Meaker moved the adoption of a resolution calling a public hearing
October 21, 2019, commencing at 7:41 P.M., local time, to consider adding a proposed Local Law to be entitled “LOCAL LAW NO. 3 OF THE YEAR 2019 TO
MUNICIPAL LAW SECTION 3-C” to the code of the Town of Clay. Motion was seconded by Councilor Pleskach.

4 Supervisor Ulatowski explained that this is the precautionary measure each year although the Town has yet to exceed the cap which results in the refund check homeowners receive.
SPECIAL PERMIT (CPH) – TOWN BOARD CASE # 1146 - TJA CLEAN ENERGY:
Councilor Hess moved the adoption of a resolution calling a public hearing October
21, 2019, commencing at 7:44 P.M., local time, to consider the application of TJA
pursuant to Section 230-27 I. (2) (E) to allow for a solar farm located at 4893 Grange Road, Tax Map No. 063.-01-08.0. Motion was seconded by Councilor Bick.
Ayes – 7 and Noes – 0. Motion carried.
PREVENTION OF CRUELTY TO ANIMALS:
Councilor Young moved the adoption of a resolution authorizing the Supervisor to
enter into an agreement with CENTRAL NEW YORK SOCIETY FOR THE PREVENTION OF CRUELTY TO ANIMALS for the year 2020 in the amount of $10,477.08, for all services for the treatment of animals on behalf of the TOWN OF CLAY, and execute the necessary document therefore. Motion was seconded by Councilor Hall.

OF CLAY TOWN HALL BUILDING AND SENIOR CENTER:
Councilor Meaker moved the adoption of a resolution authorizing the Supervisor to
execute an agreement with JANITORIAL/CLEANING SERVICES FOR THE TOWN OF CLAY TOWN HALL BUILDING AND SENIOR CENTER with OSWEGO INDUSTRIES for $22,042.98 for a term of nine months, commencing 10/13/2019 and terminating 6/30/2020 with an option to renew under the same terms and conditions and upon written consent of both parties to align with Prevailing Wage adjustments.
