The meeting was called to order by Supervisor Ulatowski at 7:30 P.M. All present joined in the Pledge of Allegiance.

Approval of Minutes:

Councilor Hess made a motion to approve the minutes of the May 20, 2019 meeting.

Motion was seconded by Councilor Hall.

Supervisor Ulatowski said that he knew of no requests for adjournments or cancellations.

Correspondence:

Supervisor Ulatowski asked if anyone wished to address the Board on any items not on the agenda.

Julie Hyne and Sharon Devaney of Orion Path were present to inquire about the status of the paving to Orion. They began by asking why paving had begun on Princess Path when they were told that Orion would be the first paving job of 2019. REGULAR MEETING OF THE TOWN BOARD – June 3rd, 2019 Town of Clay

2 Supervisor Ulatowski agreed with the two women and said that he would follow up with the Highway Superintendent in the morning adding that this was the first that he was aware of it.

Ed Dotterer of Whispering Woods Terrace said that he had complaints also about the process the Highway Department uses to repair the roads, rock slurry, a mixture of oil and stone. The Supervisor explained that it is his understanding that it is a two- step process and after the “slurry” has a chance to settle it will be topped with a coating.

Jackie Samora and Anthony and Barbara Fischetti of Bayberry were present to ask about the repair of Lark and Nightingale Paths. They produced pictures of the road. Mr. Fischetti showed a picture on his phone of where the road has heaved; the Clerk asked him to email the picture to her. Supervisor Ulatowski said that he and Mr. DeTota will visit the area to survey the road. He gave a brief explanation of the Cornell Study and how the paving schedule is based on this scientific study but adding that it may be obsolete and they are researching a new study.

Nancy Schilling and Ule Wood were present again to inquire about the sink hole and drainage issues on McNamara Drive. Ms. Schilling said that someone from the Town had come to her house but she didn’t make it to the door in time. Supervisor Ulatowski asked if the sink hole had been fixed. Ms. Schilling said that they covered it with plywood but it had not been repaired thus far. The Supervisor said that he would again instruct them to fix the drainage and sink hole.

Brad Page of Steppingstone Lane asked about the policy regarding trailers. He continued that neighbors of adjoining properties both park large boats or trailers obscuring his view. Councilor Pleskach explained that the trailer ordinance was amended last year and there is a stay on prosecution for a year to get into compliance however there is still a limit of one per address. Supervisor Ulatowski said that he would drive by to check it out.

REGULAR MEETING

Agreement (Correction) - ALL CITY MANAGEMENT SERVICES, INC.:

Councilor Hall moved the adoption of a resolution accepting and authorizing the

Supervisor to execute the Amendment to the existing Agreement with ALL CITY MANAGEMENT SERVICES, INC., for providing School Crossing Guard Services, whereby the Town agrees to increase the pay per hour the sum of Twenty-Two Dollars and Eighty-Five Cents ($22.85) for guard service to be provided. Motion was seconded by Councilor Pleskach.

REGULAR MEETING OF THE TOWN BOARD – June 3rd, 2019 Town of Clay

3 Project (drainage) (PH) RED BARN ACRES DRAINAGE DISTRICT, CONTRACT NO. 2 – LATERAL:

A public hearing to consider a petition for the extension of a public drainage system located within the Town of Clay to be known as “RED BARN ACRES DRAINAGE DISTRICT, CONTRACT NO. 2 – LATERAL,” and for the construction and acquisition of said storm sewer/overland drainage facility therein, was opened by the Supervisor; proof of publication and posting was furnished by the Town Clerk.

William Morse of WBM Engineering was present on behalf of the applicant. He began by explaining that this drainage district will serve the commercial portion which includes Brooklyn Pickle and future commercial parcels; the residential portion is served by the drainage pond off Red Barn Circle. The water will drain toward North Medical Center with a driveway to access the easement. Mr. Morse added that the access will eventually be paved. Councilor Hall asked if the proposed drainage will be large enough to handle the full buildout; Mr. Morse said that it will. There being no more questions, the Supervisor closed the public hearing.

Project (drainage) (A) RED BARN ACRES DRAINAGE DISTRICT, CONTRACT NO. 2 – LATERAL:

Councilor Meaker moved the adoption of a resolution approving the extension of a

public drainage system located within the Town of Clay to be designated and known as “RED BARN ACRES DRAINAGE DISTRICT, CONTRACT NO. 2 – LATERAL.” Motion was seconded by Councilor Young.

Ayes – 7 and Noes – 0. Motion carried.

Project (acquire public facilities) - RED BARN ACRES DRAINAGE DISTRICT, CONTRACT NO. 2 – LATERAL:

Councilor Meaker moved the adoption of a resolution that it is in the public interest

that the Town of Clay approve the construction and acquire the storm sewer/overland drainage facilities located within “RED BARN ACRES DRAINAGE DISTRICT, CONTRACT NO. 2 - LATERAL,” and in accordance with the terms and conditions of a certain Agreement to be entered into between the Town of Clay and RED BARN COUNTRY, LLC for the construction and acquisition of said facilities within “RED BARN ACRES DRAINAGE DISTRICT, CONTRACT NO. 2 – LATERAL.” Motion was seconded by Councilor Hess.

4 Project (approving final plans) - RED BARN ACRES DRAINAGE DISTRICT, CONTRACT NO. 2 – LATERAL:

Councilor Meaker moved the adoption of a resolution approving the FINAL PLANS

for RED BARN ACRES DRAINAGE DISTRICT, CONTRACT NO. 2 – LATERAL, (adjacent to the Brooklyn Pickle site), and authorizing the Supervisor to execute the necessary forms therefore. Motion was seconded by Councilor Hess.

Ayes – 7 and Noes – 0. Motion carried.

Appointment (A) – MOYERS CORNERS FIRE DEPARTMENT, INC. – STATION 1:

Councilor Young moved the adoption of a resolution approving the appointment of

Bryan Brown, Elijah Gromling and Jennifer Riddle as volunteer members of the MOYERS CORNERS FIRE DEPARTMENT, INC. – STATION 1. Motion was seconded by Councilor Pleskach.

Ayes – 7 and Noes – 0. Motion carried.

Special Permit (Correction) – Town Board Case # 1139 - ABUNDANT SOLAR POWER (CL1) LLC:

Councilor Hess moved the adoption of a resolution striking the resolution for

Abundant Solar Power (CL1) LLC from the May 6, 2019 Town Board Meeting to include Tax Map No. 17.-03-12.0. This parcel is not part of the Abundant Solar Project. Motion was seconded by Councilor Bick.

Ayes – 7 and Noes – 0. Motion carried.

Special Permit (CPH) – Town Board Case # 1140 – SEMPER FORTIS LLC, D/B/A DREAM DRIVE EXOTICS:

Councilor Pleskach moved the adoption of a resolution calling a public hearing June

17, 2019, commencing at 7:35 P.M., local time to consider the application of SEMPER FORTIS LLC, D/B/A DREAM DRIVE EXOTICS for a SPECIAL PERMIT pursuant to Section 230-16C. (2) (e) [11] & [12] to allow for outdoor recreation in the former Sears parking lot at the Great Northern Mall, located at 4155 State Route 31, Tax Map No. 028.-01-40.4. Motion was seconded by Councilor Hess.
