The meeting was called to order by Supervisor Ulatowski at 7:30 P.M. All present joined in the Pledge of Allegiance.
Approval of Minutes:
Supervisor Ulatowski said that Councilor Hess suggested that the wording should be changed in the unapproved minutes regarding Mr. LaPoints comments about the Historical Park. He “corrected”, asked if by changing to stated and added wants to
know when the monies will be transferred. Councilor Hess made a motion to
approve the minutes of the April 15th, 2019 meeting as amended. Motion was seconded by Councilor Young.
Ayes — 6 and Noes — 0. Motion carried. Councilor Pleskach abstaining.

Supervisor Ulatowski said that he knew of no requests for adjournments or cancellations.

Supervisor Ulatowski asked if anyone wished to address the Board on any items not on the agenda.
Ule Wood of McNamara Drive said that she had heard that the developer of Orange Commons would be having a walk through; however, the residents still have concerns about the pond and drainage that have not been satisfactorily addressed. Supervisor Ulatowski asked the Town Engineer and the Commissioner of Planning and Development if that is in the works. Ron DeTota said that it is not scheduled. He continued that there is a list of items but he is not sure of the status. Supervisor Ulatowski said that there are concerns prior to accepting the road. Councilor Bick added that this will be handled with the highest amount of care for the residents. Mr. DeTota directed the resident(s) to email the Supervisor with all of their concerns. Councilor Pleskach asked if there was money still in escrow to be held until the concerns are met; there is. Another resident, Nancy Schilling of 8533 McNamara Drive said that she has a sink hole in her back yard that she is very concerned about hecause she has a three year old child. She said that she called the highway department and they put a cone over the hole but have not done anything else to address it. Supervisor Ulatowski said that he will look into this.
Shannon Knapp of Dormar Drive asked why the old agenda was still on the web this afternoon. Councilor Hall said that it had been updated late in the day. Mike LaPoint asked again about the Town’s relationship with the Historical Park. He reiterated that when the renovations were being done to the Senior Center, residents were allowed to use the Historical Park building for meetings but since the completion of the renovations only the Senior Center is available. He continued that two years ago $2100.00 was allocated for the Historical Park and last year $10,000.00 was allocated; however, it is not available for use by residents although it is a financial responsibility in the Town Budget. Supervisor Ulatowski explained that it can be used for historical functions and the housing/storage of historical artifacts. He said that he would talk to his financial person regarding the budget inquiry.
Mr. LaPoint then explained that there are trucks in the park in Cherry Estates parking on the lawn on the middle of the night, specifically at 3:56 and 4:04 AM.
He said that there are several residents complaining and some have gotten plate numbers, but the Sheriffs said that they cannot do anything unless they see it happening. Supervisor Ulatowski said that he will contact the Sheriffs Department to request that they patrol and will give the time that these incidents are happening.
Mr. LaPoint concluded by inquiring about paving on Evesborough Drive. He said that he was told this year that it is not on the schedule and last year, someone in the Highway Department said that it had been completed. He explained that REGULAR MEETING OF THE TOWN BOARD - May 6, 2019

Evesborough Drive is like Orion Path, some areas are beautiful and some are like a mine field. Supervisor Ulatowski said that he promised he would follow up, and get over and see the road. Mr. LaPoint asked if the Town is still using Suit Kote adding that they had done Perruggia Lane a few years ago and there are greater drainage issues than before the road was done. Ron DeTota said that they must follow Town specs when completing work. The Supervisor said that he would follow up with Highway.
MAIDER ROAD WATERFRONT SITE (funding):
Councilor Young moved the adoption of a resolution appropriating $3,292,222, for
the remediation of the Maider Road Waterfront Site, an environmental restoration site, to be funded with 90% grants-in-aid and $302,220, local share hereby authorized to be transferred from the Capital Reserve Fund of the Town. Motion was seconded by Councilor Pleskach.

LOCAL LAW No. 2 OF 2019 (PH/Adj.) — Chapter 230-11-C —Zoning:
A Public hearing to consider proposed LOCAL LAW NO. 2 OF THE YEAR 2019 to amend the Town of Clay Code Sections 230-11C. SENIOR ASSISTED LIVING
DEVELOPMENT AND SENIOR INDEPENDENT LIVING FACILITY, by lowering the minimum age from 62 and older to 55 years of age and older in all R- SR senior residence districts including the “Intent” language. (Adjourned to this date and time from the April 15, 2019 Town Board Meeting) was opened by the Supervisor.
Supervisor Ulatowski began by giving a brief overview from the previous meeting surmising that by lowering the age to 55 it may encourage more seniors to stay in the area.
Mike LaPoint asked if an individual facility could raise the age to 62 or 65 and they could. He also asked if children would be allowed; if the parents meet the age requirement children would be permitted. Councilor Hall said that residents may wish to move into their last home while still working. The Supervisor concluded by saying that this local law will give options without restricting age.
There being no more questions or comments, the Supervisor closed the public hearing.

Bid Award — PROVIDING and MAINTAINING a POUND/SHELTER for ANIMALS SEIZED by an AUTHORIZED DOG CONTROL OFFICER, or other AUTHORIZED OFFICER or EMPLOYEE of THE TOWN OF CLAY:
Councilor Young moved the adoption of a resolution awarding a 1 (one) year
contract for PROVIDING AND MAINTAINING A POUND/SHELTER FOR
AUTHORIZED OFFICER OR EMPLOYEE OF THE TOWN OF CLAY to CNY Veterinary Services (see attached schedule for services). Said vendor being the only responsible bidder. Motion was seconded by Councilor Bick.

WHISTLE BLOWER POLICY (A):
Councilor Meaker moved the adoption of a resolution adopting the Town of Clay
Whistleblower Policy pursuant to Civil Service Law, Section 75b. Motion was seconded by Councilor Hess.

Special Permit(CORRECTION) - Town Board Case # 1139 - ABUNDANT SOLAR POWER (CL1) LLC:
Councilor Hess moved the adoption of a resolution striking the SEQRA resolution
for Abundant Solar Power (CL1) LLC from the April 15, 2019 Town Board Meeting, and amend the SEQRA resolution for Abundant Solar Power (CL1) LLC of the March 18, 2019 Town Board Meeting to include Tax Map No. 17.-03-12.0. Motion was seconded by Councilor Bick.

TRAFFIC & VEHICLES (Stop Signs)(CPH) —- Turtle Cove Road and Stepping Stone Lane:
Councilor Pleskach moved the adoption of a resolution calling a public hearing May
20, 2019, commencing at 7:35 P.M., local time, to consider the proposed amendment of CHAPTER 211, entitled “TRAFFIC AND VEHICLES ORDINANCE?” of the Code of the Town of Clay, SECTION 211-12 ‘STOP INTERSECTIONS, described in SCHEDULE IX (§211-42), of the Town of Clay Municipal Code to designate and add two (2) additional stop signs, in addition to the existing stop sign on Stepping Stone Lane, for a total of three stop signs, to be installed on the corner of Turtle Cove Road and Pine Hollow Drive to create a three-way stop, stopping traffic on both Turtle Cove Road and Pine Hollow
