Clay's Town Board denied three battery energy storage special-permit applications without prejudice on September 9, 2026. The approved minutes record a separate 6–0 vote on each application. The decisions covered case 1243, NEXAMP doing business as Wetzel Road Storage, at 4664 Wetzel Road; case 1244, NEXAMP doing business as Long Branch Storage, on Long Branch Road; and case 1245, Carson Power, at 7846 and 7850 Goguen Drive. The board's findings cited the need for a comprehensive regulatory framework, clear standards, appropriate siting, fire safety and emergency-response planning. They also addressed the relationship of the proposed facilities to nearby residential and commercial uses. The decisions said the applications, as presented, did not provide sufficient assurance that the proposed use could be appropriately regulated and address those impacts. Denial without prejudice was not an approval. The findings expressly said the denials were not intended to prevent the applicants from pursuing future applications capable of addressing the identified concerns under applicable town regulations. The September 9 findings also stated that the town had adopted a BESS ordinance and that its moratorium on considering and approving applications remained in effect through October 10. That is the dated account in these minutes, not confirmation that the moratorium subsequently expired or that no later action occurred. This report covers the three September 9 decisions. It does not establish the outcome of later applications, variance hearings or proposed tax changes. Those are separate matters requiring their own records.
