REGULAR MEETING:
ZONE CHANGE (PH) Town Board Case #1197 - NELSON ASSOCIATES ZONE CHANGE/SHARON CHEVROLET:
A public hearing to consider the application of NELSON ASSOCIATES ZONE CHANGE/SHARON CHEVROLET for a Zone Change from RA-100 Residential Agricultural District to HC-1 Highway Commercial District to allow for an expansion of existing auto dealership on land located at 3687 State Route 31, part of Tax Map No. 020.-01-14.4, consisting of +/- 1.87 acres of land. (ADJOURNED FROM THE 3/4/24 MEETING) was opened by the Supervisor.
Tim Coyer of Januzi and Romans was present on behalf of the applicant and began by explaining that there are no changes to the plan and the Planning Board gave a favorable recommendation.
Supervisor Ulatowski asked how many new parking spots would be provided. There will be 120 new spots to park vehicles on site. Councilor Bick asked where the water will drain. Mr. Coyer said that it will drain to the north, not across Route 31.
Councilor Hess asked it the access easement will be extended; Mr. Coyer said that they will do that.
There being no more questions or comments, the Supervisor closed the public hearing.
Supervisor Ulatowski said that he would open both public hearings together.

SPECIAL PERMIT (PH) Town Board Case # 1198 - @P2 PROPERTIES, LLC (coffee shop/café):
A public hearing to consider the application of QP2 PROPERTIES, LLC for a Special Permit to allow for a drive-in coffee shop/cafe pursuant to Section 230-18 G.(1)(b) — Site Plan Special Permit, on land located at 4595 NYS Route 31, Tax Map No. 045.-01-02.1. (ADJOURNED FROM THE 3/4/24 MEETING) Alex Wisnewski explained that they are proposing a drive thru service window on both the proposed bank, and the Café Kubal. He continued that they received a positive recommendation from the Planning Board. He explained that there are no changes from the previous hearing. Mr. Wisnewski stated that he sat at the existing Café Kubal on March 8" from 7:10 AM to 8:30 AM (peak hours) and counted 27 cars; 14 of the 27 using the drive-thru. He concluded that the traffic study suggested 50-53 peak for the new location making this a fair and accurate estimation. Mr. Wisnewski added that the Dunkin Donuts had a larger line.
All questions and comments heard; the Supervisor closed the public hearing.

REGULAR MEETING OF THE TOWN BOARD - April 1, 2024 Town of Clay Goguen Drive, Tax Map No. 087.-01-08.1 consisting of +/- 6.24 acres of land. (ADJOURNED FROM THE 2/5/24 & 3/4/24 TB MEETING)
Supervisor Ulatowski opened the public hearing explaining to the vast and vocal crowd that the applicant would give a brief overview. The Town Board and the public will then have the opportunity to ask questions. He asked that people try not to be redundant.
James Trasher of CHA began by explaining that he was newly involved with this application and that the purpose tonight was for him to collect questions to be researched and answered at a later hearing. He continued that he does not have an abundance of technical comments or answers and plans to research the application to give well studied answers. The residents were unreceptive to this answer.
Supervisor Ulatowski asked for clarification as to the difference between a batch plant, concrete and cement. Geoff Hillenbrand of Plumley Engineering explained that no heat is used in a batch plant; cement is made by heating limestone and concrete, which emits greenhouse gases. No fossil fuels are released in a batch plant and only minimal dust. Many residents balked at this statement. The Supervisor asked about the height of the proposed structure. Mr. Trasher said 50’ or less; he is working with the manufacturer. There was a discussion as to whether the structure is enclosed either fully or partiaily.
Councilor Hess thanked the residents for coming; both those in favor and those opposed to the application. He asked the applicant if they will seek a height
variance if the structure does not meet the code. He added that he would like to see the DEC Permit.
Councilor Young asked to be walked through the process. Mr. Hillenbrand explained that the (dry) sand and limestone is placed in the hopper, then to a conveyor belt, water and cement are then added. Councilor Young asked if the conveyor is fully enclosed. Mr. Hillenbrand said only over the top and it then travels to a second conveyor to a hopper where it is mixed (that is fully enclosed), then dumped into a chute (enclosed) into trucks. Many residents began loudly protesting. One resident asked if they had permission to begin making concrete before the permit was granted. Another resident asked if they had applied to construct this business anywhere else and been denied.

REGULAR MEETING OF THE TOWN BOARD - April 1, 2024 Town of Clay Many residents spoke out primarily in opposition to the application, stating concerns with infrastructure, increased traffic, decrease in property values, noise and air quality. One resident asked who will monitor the air quality; the DEC is responsible for that. Another resident asked if the Special Permit could be revoked if the applicant does not adhere to guidelines. It can after a violation has been issued and the violation has not been corrected. It will go through the legal process ending with revocation of the Special Permit.
Councilor Hess made a motion to adjourn the public hearing to May 6, 2024 at 7:38

Councilor Magaro-Dolan moved the adoption of a resolution approving the use of
funds by the Town of Clay with respect to the applications for funding filed with ONONDAGA COUNTY COMMUNITY DEVELOPMENT for the year 2024. Motion was seconded by Councilor Young.

Special Permit (PH) Town Board Case # 1202 - JUSTIN'S CANINE CAMPUS:
Councilor Magaro-Dolan moved the adoption of a resolution approving the
application of JUSTIN’S CANINE CAMPUS for a Special Permit pursuant to Section 230-16C.(2)(e)[14] — Animal Care/Training Facility, on land located at Clay Common’s, Oswego Road, Tax Map No. 066.-01-48.4 to allow for a dog daycare. Motion was seconded by Councilor Bick.

Contract - TOWN OF CLAY LANDFILL POST CLOSURE ENVIRONMENTAL MONITORING PROGRAM:
Councilor Pleskach moved the adoption of a resolution authorizing the Supervisor
to execute a contract with C&S ENGINEERS, INC., for professional services to be rendered for the year 2024 in compliance with the DEC Regulations for the
MONITORING PROGRAM. Said services not to exceed the sum of $9,200.00. Motion was seconded by Councilor Magaro-Dolan.

Zone Change (PH) Town Board Case #1200 - S&G ACQUISITIONS:
Councilor Hess moved the adoption of a resolution calling a public hearing on April
15, 2024, commencing at 7:35 P.M., local time, to consider the application of S&G ACQUISITIONS for a Zone Change from O-1 Neighborhood Office District to LuC-2 Limited Use District for Restaurants, to allow for an event space and commissary kitchen on land located at 5570 Caughdenoy Road, Tax Map No. 079.-05-73.1 f/k/a 079.-05-73.0, consisting of +/- 6.5 acres of land. Motion was seconded by Councilor Magaro-Dolan.

Bid Award - Town of Clay New Town Hall Roof:
Councilor Hess moved the adoption of a resolution awarding the bid for the Town
of Clay New Town Hall Roof, and authorizing the Supervisor to execute a contract with Pulver Roofing, the lowest responsible bidder in the amount of $494,000.00. The Agreement shall be approved as to form and content by the Town Attorney. Motion was seconded by Councilor Magaro-Dolan.

Councilor Young moved the adoption of a resolution authorizing the Supervisor to
execute an Agreement with ALL CITY MANAGEMENT SERVICES for providing School Crossing Guard Services for a one (1) year period; to commence on or around July 1, 2024, to June 30, 2025 (2024/2025 school year). This agreement may be renewed under the same terms for two (2) additional school years (2025-2026 and 2026-2027) upon written consent by both parties. The Town agrees to pay for the services rendered pursuant to the Agreement, the sum of Thirty-Two Dollars and Three Cents ($32.03) per hour of guard service to be provided. The cost of providing One Thousand, Nine Hundred Eighty (1,980) hours of service shall not exceed Sixty-Three Thousand Four Hundred Twenty 00/100 Dollars ($63,420.00), and further authorizing the Supervisor to execute the necessary documents therefore. The Agreement shall be approved as to form and content by the Town Attorney. Motion was seconded by Councilor Magaro-Dolan.

_ To the Town of clay residents, below is the new environmental and public health statements about Ready mix concrete. facilities
“A ready-mix concrete plant creates sources of public health and local environmental risks due to noise pollution, irritant dust, air emissions and the potential for contaminated water discharge. These
locations contain industrial operations that mix cement, aggregates, and water to create concrete mixtures, which are then transported to construction sites for use. The facility consists of batching plants, mixing equipment, storage silos, and loading areas. Local air quality can be impacted from Operational generated emissions and for the transport of material. Operational impacts are due to emissions generated during the mixing process including particulate matter, nitrogen oxides, carbon monoxide, volatile organic compounds, and sulfur dioxide are among the pollutants that may be released from the facllity. Other sources of air pollution can occur from the disturbance of nuisance dust from trucks and other traffic added to the area like particulate matter, irritant dust, nitrogen oxides, carbon monoxide and carbon dioxide. The local community can be affected by these chemicals and exacerbate respiratory issues, particularly among vulnerable populations. To mitigate these emissions, the implementation of dust collectors, emission control systems, and regular maintenance schedules is imperative. Additionally, continuous monitoring of air quality can ensure compliance with regulatory standards and minimize adverse effects on air quality. Water resources are another critical aspect affected by ready mixed concrete facilities as water from the facility can be discharged. These sources include water for mixing purposes and any discharge. of washout water contaminated with concrete. Contaminated water can contain high pH levels and harmful chemicals which not only affect the local environment but can impact local water quality without proper mitigation. To address this concern, stringent Best Management Practices (BMPs) can be enforced to control water usage and prevent contamination of nearby water bodies like not storing chemicals outside, secondary containment any tanks and areas where chemicals are handled and using a contained area for any concreate washout. Proper containment and treatment of any dischargeable water must be completed to protect the local public health and environment.
Noise pollution can create environmental issues as the operation of heavy machinery and transportation activities can generate excessive noise levels, potentially impacting nearby residential areas and local wildlife. These impacts can lead to stress-related health issues among nearby residents, including sleep disturbances and heightened anxiety. To mitigate this impact, noise barriers and
soundproofing techniques can function as measures to minimize noise propagation and protect the well- being of surrounding communities.
Lastly ready mix concreate facilities can increase traffic to the focal area from the transportation of raw materials to the facility and delivery of concrete mixtures to construction sites. Increased traffic
" may contribute to traffic congestion, road wear and increase the risk of accidents and injuries for
motorists and pedestrians around and in the facility. These concerns can be mitigated through traffic management plans including scheduling deliveries during off-peak hours and implementing infrastructure improvements, including road construction, speed restrictions and improved signage can be implemented where necessary.”

As a resident of this community, I strongly believe that such a development would have significant negative impacts on our quality of life and environment.
The construction and operation of a Concrete Batch Plant would introduce various environmental hazards to our neighborhood. These facilities are known to emit pollutants such as particulate matter, nitrogen oxides, and | volatile organic compounds, which can pose serious health risks, particularly to vulnerable populations such as _ichildren, the elderly, and individuals with respiratory conditions. Furthermore, the increased traffic, noise, and dust generated by the plant would further degrade air quality and disrupt the peaceful ambiance of our community. ;
3 The proposed location of the Concrete Batch Plant is in close pkpximity to residential properties, raising concerns about property values and potential safety hazards. Studies have shown that the presence of industrial facilities can negatively impact property values, making it more difficult for homeowners to sell their properties
or obtain fair market prices. Additionally, the storage and transportation of raw materials and chemicals
associated with the operation of the plant could pose safety risks, including the possibility of accidents or spills that may endanger nearby residents. ;
Beyond the immediate environmental and health concerns, the construction of a Concrete Batch Plant contradicts the character of our community. Our neighborhood is a peaceful residential area where families come to enjoy a safe and healthy environment. The introduction of heavy industrial activity not only
undermines this character but also sets a dangerous precedent for further industrial encroachment into residential areas. : ;
1 urge you to carefully consider the potential negative impacts of the proposed Concrete Batch Plant on our community and to take decisive action to prevent its construction. | am located on Nestling Duck in the Wildcreek Neighborhood off of Wetzel Road and this concrete plant will quite literally be in my backyard. | am a father to a 6 month old boy who has health issues at it stands now and reducing the air quality he will grow up in will surely not aid in his development. I have been a resident of the Liverpool area over 30 years- Pompton Knolls for 17 years and Bayberry for 13 years. This is a residenitial area with many housing developments, apartment complexes, Liverpool School. District which includes Elementary levels, Middle School and High School level, Nursery Schools, Town of Clay Park, YMCA on Wetzel Road, Churches, and more in Liverpool and Bayberry alone. The Restaurants and shopping centers on Route 31 are about 5 miles from the proposed building site. They are all High Danger Zones. Check out the map to see what regions of CNY are within the 20 mile radius of a Danger Zone.
With this research being presented, you are considering a facility with high health and environmental effects to ANYONE within the 5 mile radius who will be ina HIGH DANGER ZONE, and within the 20 mile radius there will be a DANGER ZONE! How can you be willing to risk the health and environmental effects by allowing the Concrete Batch Plant?
Tam VERY concerned, as a long-term resident of Clay (Liverpool)with many friends here, as a parent and grandparent, but also as a Registered Nurse in the Medical Field for 52 years. There are great concerns to me for the health risks for family and friends who have respiratory issues, cardiac issues and cancers, This current proposal is incompatible with the surrounding neighborhoods, may be harmful to the environment, and may represent a health threat for some of our citizens. To the Town of clay residents, below is the new environmental and public health statements about Ready mix concrete facilities
“A ready-mix concrete plant creates sources of public health and local environmental risks due to noise pollution, irritant dust, air emissions and the potential for contaminated water discharge. These
locations contain industrial operations that mix cement, aggregates, and water to create concrete mixtures, which are then transported to construction sites for use. The facility consists of batching plants, mixing equipment, storage silos, and loading areas. Local air quality can be impacted from operational generated emissions and for the transport of material. Operational impacts are due to emissions generated during the mixing process including particulate matter, nitrogen oxides, carbon monoxide, volatile organic compounds, and sulfur dioxide are among the pollutants that may be released from the facility. Other sources of air pollution can occur from the disturbance of nuisance dust from trucks and other traffic added to the area like particulate matter, irritant dust, nitrogen oxides, carbon monoxide and carbon dioxide. The focal community can be affected by these chemicals and exacerbate respiratory issues, particularly among vulnerable populations. To mitigate these emissions, the implementation of dust collectors, emission control systems, and regular maintenance schedules is imperative. Additionally, continuous monitoring of air quality can ensure compliance with regulatory standards and minimize adverse effects on air quality. Water resources are another critical aspect affected by ready mixed concrete facilities as water from the facility can be discharged. These sources include water for mixing purposes and any discharge of washout water contaminated with concrete. Contaminated water can contain high pH levels and harmful chemicals which not only affect the local environment but can impact local water quality without proper mitigation. To address this concern, stringent Best Management Practices (BMPs) can be enforced to control water usage and prevent contamination of nearby water bodies like not storing chemicals outside, secondary containment any tanks and areas where chemicals are handled and using a contained area for any concreate washout. Proper containment and treatment of any dischargeable water must be completed to protect the local public health and environment.
Noise pollution can create environmental issues as the operation of heavy machinery and - transportation activities can generate excessive noise levels, potentially impacting nearby residential areas and local wildlife. These impacts can lead to stress-related health issues among nearby residents, including sleep disturbances and heightened anxiety. To mitigate this impact, noise barriers and soundproofing techniques can function as measures to minimize noise propagation and protect the well- being of surrounding communities. .
Lastly ready mix concreate facilities can increase traffic to the local area from the transportation of raw materials to the facility and delivery of concrete mixtures to construction sites. Increased traffic may contribute to traffic congestion, road wear and increase the risk of accidents and injuries for motorists and pedestrians around and in the facility. These concerns can be mitigated through traffic management plans including scheduling deliveries during off-peak hours and implementing infrastructure improvements, including road construction, speed restrictions and improved signage can be implemented where necessary.”

| want to let you know about my opposition to a special permit, being granted by the town of clay for the purpose of establishing a concrete batch plant on Goguen Drive near Wetzel Road. These plants have been proven beyond.a doubt to cause serious air pollution, at least within a 5 mile radius. The YMCA is located close by the proposed site, along with soccer fields, playgrounds, elementary schools, a high school, and hundreds and hundreds of homes and families.
This site is not zoned for this type of industry and [ believe that the potential harm to the people of Clay outweighs the business interests in building this type of plant there .
1am very worried about this because this is my home. | and my family have lived in the Town of Clay (within the 5 mile _radius) for over 30 years and I’m a homeowner. | have family and friends living closer to the plant as well. There is no compelling reason that has been demonstrated or communicated to allow a special permit to override what was intended for that area and allow the detrimental effects on people who live and work in the surrounding areas.
A special permit is just that - special and unusual- there would have-to be a thoroughly researched and well-founded reason to override the protections already in place for our community. | don’t believe that reason exists in this case.

Chris has always been more than just a brother to me; he's been a role model, someone I've looked up to, setting an example of what it truly means to do the right thing. Even as kids, Chris had a profound disdain for anyone who would recklessly endanger our environment or the health of those around us. | can vividly recalt how passionately he would speak out against littering, even at a young age. One of the defining moments of our shared upbringing was witnessing Chiis achieve the rank of Eagle Scout. Growing up in a scouting and military family where morals and standards were held to the highest degree, this achievement was nothing short of monumental. It was a testament to his dedication, perseverance, and the values instilled in us from a young age. Moreover, Chris's commitment to serving his country during the war in Iraq speaks volumes about his character. Concrete Batch Plant. lam a supervisor of Respiratory therapy at Upstate Medical University: My job is to help. patients who suffer from respiratory disease. | extremely disapprove of a concrete batch plant proposed for this location. Concrete batch plants produce particulate matter or particulate emissions. Particulate matter are very small particles that are carried easily in the breeze. Being so small, they penetrate into the lungs as we breath in and from that point can-cross into the blood stream. Nationwide there are countless studies that show residents who live near concrete batch plants have higher rates of developing Asthma, bronchitis, COPD, Lung cancer, decrease lung volumes, increased lung resistance, cardiac issues such as high blood pressure, peripheral artery disease and heart attack, and also kidney disease. Particulate matter causes skin, eye, sinus and throat irritation. | am sure you wouldn’t want to be a contributing cause of someone developing any of these. Any resident within a 5 mile radius of a concrete batch plant are within the HIGH RISK DANGER ZONE. Any resident within 20 miles is considered in the danger zone. {saw the handout that was given out at the meeting last night that suggests the closest house is 1700 feet away. That's a far cry from 5 miles. People within this zone aren’t just hanging out for an hour or two. This is their house, where their family is, the food they eat and the water they drink. This doesn’t even take into account the diesel trucks turning onto Henry Clay creating more pollution, increased traffic on an already traffic intersection hot spot from 5am until quitting time. f ~ Knowing all this, look at what’s located within the 5 mile radius known as the high risk danger zone. The YMCA, which 1 houses a day care. Clay Park which has car shows and several sporting events. The sporting events are almost all children whose lungs are still growing. The weekly car meet up — who is going to bring their car there with all that dust

floating around. Liverpool elementary school, Liverpool high school is maybe a half mile to a mile away. Every sports team plays there. In fact, all of Liverpool’s schools fail within that zone. Waterhouse Road has a new day care within - the zone. | have enclosed a photo that shows the 5 mile radius that is considered within the high risk danger zone. Do you live in that zone? Do your kids go to school in that zone? Family? Parents?. Work? | can’t comprehend how anyone would want this for their family, especially their children. Nationwide there are numerous lawsuits against. concrete batch plants with decent success. | highly doubt Clay would be any different if this Passes. | Is this what you really want Clay’s image to be? Is this the vision of the future you-have of: Clay? I'm not against concrete batch plants, however, it needs to be in the tight location. | do understand that area is an ; industrial park, but it doesn’t mean all industry should be there. This is bad for Clay and will greatly decrease the quality of living here. | urge you to think about your vision for Clay in the future. Think of the residents, your family, and your children.

I’m writing regarding concerns with the concrete batch plant that is proposed on Goguen Dr. off Wetzel Rd in the Town of Clay. I’m a homeowner within the. Wildcreek/Plum Hollow neighborhood off of Wetzel Rd and within two miles of the proposed plant. ; . ;
There's substantial scientific literature and past lawsuits stating the negative impacts of cement plant exposure, specifically within a 2 mile radius. These can include a higher risk respiratory issues, lung function decline, increase risk of respiratory cancers in both children and adults.
As elected representatives of residents with a number of neighborhoods in this area it is shocking to me this wasn’t already denied. This seems like a rather obvious decision, and I’m sure many of the decisions you all make can be challenging and not as clear cut. This does not seem like one of them. You have thousands of residential homes within a 2 mile radius of the plant location, North Area YMCA and Clay Central Park within a mile, Liverpool HS and Wetzel Rd Elementary within 2 miles. Many of the homes in this radius are families with young kids, as is the case with our family . _ with two children under eight years old who utilize the Clay Central Park for soccer practice/games as well as football ‘ practice/games.

Concrete batch plants should not be placed this close to residential neighborhoods, parks, and schools. Specifically when the majority of the immediate neighborhoods and parks, and community centers are downwind of the plant v with: our prevailing west wind. ~ | strongly recommend the Town immediately considering denying:this application given the location selected, facts, and supporting research provided. As elected representatives of the residents of Clay e@ each of you have an obligation to your residents and: this decision s seems obvious.

I'm writing to you as a resident of the Town of Cicero with property that adj joins the Town of Clay: asit relates tothe cement plant being considered along Weitzel Road i in Hverpool. I'm extremely concerned about the air pollution that comes from facilities such as this cement plant. Its proposed
location is only a few hundred yards from multiple Town of Clay residential developments with households numbering in the thousands as well as schools, a YMCA, several parks and playgrounds, sports fields, and shopping centers. There are studies showing :the detrimental heatth effects on populations within a 5-mile radius of these types of cement facilities. Even the EPA has stated that cement plants are a significant source of sutfur dioxide, nitrogen oxide and carbon monoxide. One study concluded: "We found an association between the exposure to the cement plant emissions and the risk of hospital admission for cardiovascular or respiratory causes, particularly strong for children. The cement plant certainly has an important role as a producer of air pollution."
: Itis notin the best interest of the community at large, and all neighboring communities who will be impacted by ' winds carrying this pollution, should the Town of Clay proceed with allowing such a cement plant to be built here.

I'm writing to you as a resident of the Town of Cicero with property that adjoins the Town of Clay as it relates to the cement plant being considered along Wetzel Road in Liverpool. . : :
I'm extremely concerned about the air pollution that comes from facilities such as this cement plant. Its proposed
location is only a few hundred yards from multiple Town of Clay residential developments with households numbering in the thousands as well as schools, a YMCA, several parks and playgrounds, sports fields, and shopping centers. There are studies showing the detrimental health effects on populations within a 5-mile radius of these types of cement facilities. Even the EPA has stated that cement plants are a significant source of sulfur dioxide, nitrogen oxide and carbon monoxide. One study concluded: "We found an association between the exposure to the cement plant emissions and the risk of hospital admission for cardiovascular or respiratory causes, particularly strong for children. The cement plant certainly has an important role as a producer of air pollution."
_ itis not in the best interest of the community at large, and all neighboring communities who will be impacted by 1 _ winds carrying this pollution, should the Town of Clay proceed with allowing such a cement plant to be built here.

We can’t believe this is even being considered for this location. #1 problem ~- MAJOR HEALTH AND ENVIRONMENTAL CONCERNS - #2 problem - This location would have a devastating impact on-a densely populated area..being located right in the middle of schools, housing developments, parks, soccer fields, nursery/day care centers, shopping, churches, etc., etc., #3 problem - Their proposal indicates 25-30 employees, which would be 25-30 personal vehicles, 10 trucks making 5 trips a day..that would bein and out 50 times a day. We think this would negatively impact Wetzel Road traffic, considering it is only two lanes and already a very busy road, with two railroad crossings. #4 problem - and we hope this is a misprint...hours would be 4:30 AM to 5:00 PM - Monday thru Friday and possibly Saturday...Saturday, the day Clay Town Park is filled with hundreds of people attending soccer/baseball games..We also find it concerning that this is being proposed now, when NYS will be enacting new laws regarding concrete plants next year. We’re sure all the construction anticipated along Route 31 now and for , Many years to come, and that they already own the property with access to Morgan Road and ‘Henry Clay Boulevard, is why they want to operate this business on Wetzel Road. However, we think a much better location could be found, one that would not have such an impact on a very large portion of the Town. We also want to add, that we have never been negative about grow

Dear Town of Clay Supervisor, Deputy Supervisor, and Councilors, | wanted to write to you to express my concerned with the proposed Concret Batch Plant at 7835 Goguen Dr. | attended the Town Board meeting in Monday March 4th. |.understand the type of modern indoor facility that is being proposed, and that this is a concrete batch plant not a cement plant. Still my concerns are with having this type of industry so close to residential property. While in perfect conditions the equipment the plant will emit minimal pollutants, reality is far from perfect especially as equipment ages. | am an engineer that works in a production environment. | fully understand the risks in a process for all stakeholders involved, and we asa community are a stakeholder.
There will be at least one silo full of pure cement powder that is needed to make concrete. Any incidents with this silo
_ could risk air contamination for the entire community. God forbid it were ever accidentally destroyed by human or [ natural disasters.
The prevention of air contamination is dependent on the filtration system in place. Any malfunction with this system risks air contamination. Equipment ages, and while they will be subject to yearly inspections there isa lot of time between irispections for things to'go wrong.
Additionally, during Mondays meeting the applicant stated that he will be crushing the left over concrete spoils with an excavator. This will be happening outside and will create access noise and dust that were not included in the air quality and noise studies that have been conducted.
| have seen accidents happen in production environments even with all preventative measures in place. We have all seen ~ accidents in news that caused environmental disasters. Murphys law states that if it can happen it will, and once it does it’s too late.

My husband and | are residents of the Town of Clay,
and we are strongly opposed to the Proposed cement factory for the following reasons:
1) The potential for health risks to the residents you represent. That alone should be enough to vote no.
2) The definite noise increase around this batching plant if approved, with large trucks day in and day out. We rented a VRBO home in the south this year that ended up being near a commercial construction site. There are dump trucks going by all day, and it is awful. The large vehicles also make walking and driving along the road feel unsafe. This will strongly
[ diminish the quality of life for Town of Clay residents, and will reduce property values all around the plant. Why on earth \would you want to do that to your own citizens who trust you to do what's best? j
3) The timing could not be worse. Micron is coming, bringing hundreds (thousands?) of high-paying jobs to the Town of Clay. These jobs represent.educated, highly-skilled people who will want to live near Micron. You know that property values have alréady increased sharply just because of the hews of this facility coming to Clay. ‘So why Is the town even considering changing existing zoning regulations to bring in a dirty, noisy plant that will diminish values? You are basically begging the Micron people to take their wealth somewhere else. Live and spend in some other town. Is that -
your job? | think not.
My husband and | are begging you to refuse to change the zoning, allowing this plant. We know you are getting heavy, well-paid pressure from the plant owner and his friends (many from outside the Town of Clay). Please consider your actual citizens, like us, who vote and will remember when elections roll around. More importantly, please do what's
right for Clay simply because It's the right thing to do.

Recently my husband and | were thrilled to learn that the property we purchased in Bayberry seven years ago is worth almost 100,000 dollars more than the price we paid for it. Our excitement, however, turned to great concern once we learned from our neighbors that there are plans for a batch concrete plant to be constructed on Goguen Drive off Wetzel Road. Our concern stems from the fact that according to the United States Environmental Protection Agency’s (EPA) website “The cement sector is the third largest industrial source of pollution, emitting more than 500,000 tons per year of sulfur dioxide, nitrogen oxide, and carbon monoxide.” The site goes on to state that these emissions can adversely affect the health of children, the elderly, and individuals with diseases such as asthma, bronchitis or emphysema. Long-term

' The site of the proposed plant is about 2 miles from our property. Located even closer to the site are Morgan Road Elementary School, Liverpool High School, North Area YMCA, and BASCOL Day Care. In addition, there are numerous

Micron is coming to Clay and with it will come highly skilled and highly paid employees. Will these employees want to live anywhere near a heavy industrial cement plant? I've known him to consult often with his closest friends just to check himself and to confirm what he is doing is best for his friends, his family, his community and everyone he can possibly benefit with his decisions. After speaking with my father, Dr. Robert A. Dracker, a prominent healthcare provider in our community, along with ~ consulting several members of my professional and research network who are more informed than | on the topic, | was | ~ reassured that the concerns of opposing parties are largely not backed up by research. I was pointed to several studies ’ via PubMed and other medical publications which weigh in on issues surrounding a Concrete vs a Cement

. manufacturing facility. | believe many people Opposed in our community are erroneously concerned about issues which | are more relevant more to a cement factory (which is not being produced) rather than a concrete batch facility (which
| is intended to be built). Many of the studies which imply negative impacts predate modern systems and cite old data
: from plants which do not have ancillary dust mitigation and water recycling apparatus installed - systems which | know

i instead being driven by an aspiration for excellence and concern for those around him in everything he sets his hands : to.
i Comparatively, | believe the plant will be less impactful on our environment and communities than some of the more
' recent local projects that have been approved in the Town of Clay, i.e. the solar plant that.was somehow allowed to be
i installed alongside an existing daycare on Waterhouse Rd. (wheré my 4 year old attends) when there have been many recent reports of ballast and capacitor systems catching fire and producing toxic and potentially fatal fumes. And | also
, believe that, in an economic environment like we-have today, projects like Chris' represent the opportunity to create
! many more solid and long-term jobs than projects like the above-mentioned solar field, with a much more positive local * economic impact than that project.
| believe we all have a bad habit in CNY of turning a blind eye to large projects like the solar field, the Amazon facilities . ! and the Micron facility, all of which are undoubtedly proven to generate massive heavy-metal particulates and _
: pollutants on an exponential scale compared to something like this. Yet we disregard and get too inflamed about the
: aspirations of business owners like Chris, whereas if we had more people creating medium-sized operations like this,
‘ we'would together make a corporeal and positive impact on the economic and general well-being of our communities.
| Micron may or may not happen... it is not our “only hope". Our best hope is helping many more aspiring business
: leaders like Chris establish operations here so.we can reach a density of economic activity which will contribute toa
_ tangible growth in the quality and standards of living of our community members who may be employed by such
: efforts.
