The meeting was called to order by Supervisor Ulatowski at 7:30 P.M. All present joined in the Pledge of Allegiance.
Approval of Minutes:
Councilor Hess made a motion to approve the minutes of the April 4, 2022 Town
Board meeting. Motion was seconded by Councilor Meaker.
Ayes – 4 and Noes – 0. Motion carried. Councilors Bick and Young abstained due to
their absence at that meeting.
Cancellation and/or requested adjournments:
Supervisor Ulatowski explained that item numbered 8 on the agenda will not be heard as the applicant has withdrawn the application; no further action will be pending.

ZONE CHANGE (SEQR) – Town Board Case # 1157 – CLAY MARKETPLACE (PDD):
Councilor Hess moved the adoption of a resolution that the proposed Zone Change
from RC-1, Regional Commercial District to PDD, Planned Development District. Said project to be known as CLAY MARKETPLACE, located on the Northeast corner of NYS Route 31 and Henry Clay Blvd, Tax Map No. 045.-01-02.1, is a Type I Action with a completed Long Form EAF and Traffic Study (by previous action of this Board a DEIS was not required). The proposed project will not have a significant effect on the environment. Motion was seconded by Councilor Meaker.
Ayes – 5 and Noes – 1. Motion carried.
ZONE CHANGE (A) – Town Board Case # 1157 – CLAY MARKETPLACE (PDD):
Councilor Hess moved the adoption of a resolution approving the Zone Change from
RC-1, Regional Commercial District to PDD, Planned Development District. Said project to be known as CLAY MARKETPLACE, located on the Northeast corner of NYS Route 31 and Henry Clay Blvd, Tax Map No. 045.-01-02.1. Consisting of a total of 14.9 acres, comprised of ninety-six (96) apartment units, in two (2) three-story buildings, and commercial sites consisting of ±30,000 square feet of retail, restaurant and office space. Motion was seconded by Councilor Meaker.

Great Northern Mall Holding, LLC (comprehensive settlement):
Councilor Meaker moved the adoption of a resolution acknowledging continued
comprehensive settlement negotiations between the Town of Clay Prosecutor and Great Northern Mall Holding, LLC., 1010 Northern Blvd, Suite 212, Great Neck, New York, 11021, with regard to efforts to resolve outstanding code REGULAR MEETING OF THE TOWN BOARD – April 18, 2022 Town of Clay

violations and compliance issues. Motion was seconded by Councilor Young.

Agreement/Authorization – STORMWATER AND EDUCATION COMPLIANCE ASSISTANCE PROGRAM:
Councilor Meaker moved the adoption of a resolution supporting participation in the
Central New York Regional Planning & Development Board’s year (15)
and authorizing the Supervisor to act on behalf of the Town of Clay and execute any and all documents necessary with regard to said matters. In line with the recommendations of the CNY Stormwater Coalition Finance Committee, the CNY RPDB (Regional Planning & Development Board) has adopted a FLAT FEE STRUCTURE to simplify the municipal budgeting process. At $3,600.00 PER MUNICIPALITY, this rate reflects shared costs for common services provided equally to all participating municipalities regardless of size or population. The funds will be available to the Board no later than January 31, 2023 to complete the project, and a certified copy of this resolution will be prepared and sent to the Board no later than November 30, 2022. Motion was seconded by Councilor Hess.

Zone Change (CPH) – Town Board Case # 1173 FIRE DETECTION SYSTEMS, INC.:
Councilor Pleskach moved the adoption of a resolution calling a public hearing May
2, 2022, commencing at 7:38 P.M., local time, to consider the application of FIRE DETECTION SYSTEMS, INC., for a Zone Change for ALLEN ROAD, Tax Map No. 112.-07-11.5 from R-1 to O-1 to allow for a non-retail office on +/-1.53 acres of land. Motion was seconded by Councilor Hess.
Ayes – 6 and Noes – 0. Motion carried.
Authorization – Credit Card Payments for Tax Receiver:
Councilor Bick moved the adoption of a resolution authorizing the Town of Clay Tax
Receiver to accept payment for real property taxes by credit card. The Town Tax Receiver may institute and adopt any specific internal policies with regard to the acceptance and use of credit cards by residents. Motion was seconded by Councilor Hess.

Hydrants (2) (A) – Horseshoe Island Road:
Councilor Young moved the adoption of a resolution authorizing the Town Supervisor
to execute an application with the Onondaga County Water Authority to install two (2) hydrants in connection with the water main replacement along Horseshoe Island Road at no charge to the Consolidated Hydrant District and the District to incur a maintenance and installation fee for 30 years from the date of installation (currently $224.95 per annum) and then a maintenance only fee thereafter (currently $76.74 per annum). Motion was seconded by Councilor Meaker.
Ayes – 6 and Noes – 0. Motion carried.
