The meeting was called to order by Supervisor Ulatowski at 7:30 P.M. All present joined in the Pledge of Allegiance.
Approval of Minutes:
Councilor Hess made a motion to approve the minutes of the September 21st, 2020
meeting. Motion was seconded by Councilor Bick.

Supervisor Ulatowski asked if anyone wished to address the Board on any items not on the agenda.
Kathleen Mancini explained that she lives at 5453 Henry Clay Boulevard. She said that now that she is working from home, she is aware of the excessive speed vehicles use on her road and is concerned.

2 Councilor Hess asked where she lives on Henry Clay Boulevard. She said that she is south of Route 31.
Supervisor Ulatowski said the we have a liaison in the Sheriff’s Department and that either he or the Clerk will reach out to them. He thanked her for bringing it to his attention.
REGULAR MEETING:
Budget 2021 – TOWN OF CLAY TENTATIVE BUDGET:
Town Clerk presents the 2021 TOWN OF CLAY TENTATIVE BUDGET to the Town Board Members pursuant to Town Law.
Special Permit (SEQR) – Town Board Case # 1151 - ROCKLYN COMMERCIAL, LLC AND WOODSIDE COMMERCIAL, LLC:
Councilor Hall moved the adoption of a resolution that the application of ROCKLYN
SPECIAL PERMIT pursuant to Section 230-18G.(2)(b) to allow for the construction of a WellNOW Urgent Care (hospital/clinic) on vacant land located at 4938 West Taft Rd. and Wintersweet Dr., Tax Map No. 116.1-01-01.1, is an unlisted action with a completed EAF and involves no other permit granting agency outside the Town. The proposed project will not have a significant effect on the environment and therefore does not require the preparation of an EIS. Motion was seconded by Councilor Bick.

Special Permit (A) – Town Board Case # 1151 - ROCKLYN COMMERCIAL, LLC AND WOODSIDE COMMERCIAL, LLC:
Councilor Hall moved the adoption of a resolution approving the application of

Resolution (A) Local Law No. 5 of the Year 2020 – Real Property Tax Law (RPTL) – Section 487:
Councilor Hess moved the adoption of a resolution approving Local Law No. 5 of
2020 pursuant to Section 487 of the Real Property Tax Law (RPTL) to “opt out” REGULAR MEETING OF THE TOWN BOARD – October 5th, 2020 Town of Clay
3 of allowing real property tax exemptions pursuant to Section 487 of the PRTL and declare improvements related to solar and wind energy systems fully taxable in the Town of Clay. Motion was seconded by Councilor Hall.

Agreement - CENTRAL NEW YORK SOCIETY FOR THE PREVENTION OF CRUELTY TO ANIMALS for the year 2021:
Councilor Bick moved the adoption of a resolution authorizing the Supervisor to
enter into an agreement with CENTRAL NEW YORK SOCIETY FOR THE PREVENTION OF CRUELTY TO ANIMALS for the year 2021 in the amount of $10,477.80, for all services for the treatment of animals on behalf of the TOWN OF CLAY, and execute the necessary document therefore. Motion was seconded by Councilor Hess.
Councilor Young asked if this covers cruelty involving cats as well. The Supervisor said that it does.

Authorization/Grant - JUSTICE COURT ASSISTANCE PROGRAM (JCAP):
Councilor Meaker moved the adoption of a resolution authorizing Judge Schiano
and Judge Lauri to make the necessary applications for a grant from New York State for the JUSTICE COURT ASSISTANCE PROGRAM (JCAP) on behalf of the Town of Clay in the 2020-2021 Grant Cycle up to $30,000; and the execution therefore. Motion was seconded by Councilor Hess.

Councilor Meaker moved the adoption of a resolution calling a public hearing
October 19, 2020, commencing at 7:35 p.m., local time to consider adding a proposed Local Law to be entitled “LOCAL LAW NO. 6 OF THE YEAR 2020 TO
MUNICIPAL LAW SECTION 3-C” to the code of the Town of Clay. Motion was seconded by Councilor Pleskach.
Ayes – 7 and Noes – 0. Motion carried.

4 ZONE CHANGE – Town Board Case # 1153 - NJJP HOLDINGS, LLC/LIVERPOOL VILLAGE ANIMAL HOSPITAL WELLNESS CENTER:
Councilor Pleskach moved the adoption of a resolution calling a public hearing
October 19, 2020, commencing at 7:38 p.m., local time to consider the application of NJJP HOLDINGS, LLC AND JOSE VARGAS FOR A ZONE CHANGE from O-1 Neighborhood Office District to HC-1 Highway Commercial District to allow for a Veterinary Clinic located at 7270 Buckley Rd., N. Syracuse, Tax Map No. 112.-07-14.0, consisting of approximately 0.9± acres of land. Motion was seconded by Councilor Meaker.

ZONE CHANGE – Town Board Case # 1154 (CPH) – SONBYRNE SALES, Inc./ CHRISTIAN BRUNELLE:
Councilor Pleskach moved the adoption of a resolution calling a public hearing
October 19, 2020, commencing at 7:41 p.m., local time to consider the application of SONBYRNE SALES, INC. AND EARL WHITE, JR. & PATRICIA WEBER
FOR A ZONE CHANGE from I-1 Industrial District to LUC-1 Limited Use for Gasoline Services District to allow for the construction of a Byrne Dairy Retail Store, Car Wash and Fueling Facility on properties located at 7426, 7434 & 7440 Morgan Road, Clay, Tax Map Nos. 105.-01-08.0, 09.0, 10.0 & 11.1, consisting of approximately 6.95± acres of land. Motion was seconded by Councilor Hess.
