Approval of Minutes:
Councilor Hess made a motion to approve the minutes of the April 20, 2020 meeting.
Motion was seconded by Councilor Meaker.

Supervisor Ulatowski said that the Town has been keeping up with the responsibilities entrusted to the town while working at a reduced level while working towards the reopening of the State; he continued that all items will be heard tonight.

REGULAR MEETING:
Project/Sewer – (CPH) (amendment) - Nelson Associates, LLC, James M. Donegan and Widewaters Farrell Road Company, LLC:

Councilor Hess moved the adoption of a resolution that the Town of Clay amend
terms of a Sanitary Sewer District Agreement dated 6/18/18 between the Town of Clay, Nelson Associates, LLC, James M. Donegan and Widewaters Farrell Road Company, LLC, and to also amend the terms of the second amendment to the Sanitary Sewer District Agreement dated 9/6/19 to change the date for completion of the Sanitary Sewer District construction to take place no later 11/1/20, and authorizing the Supervisor to execute the necessary documents therefore. Motion was seconded by Councilor Meaker.
Ayes – 7 and Noes – 0. Motion Carried. Supervisor Ulatowski asked the Town
Attorney and the Town Engineer if everything was in order. They agreed that it was.
ZONE CHANGE (CPH) # 1150 – MVAH HOLDING, LLC and FAITH JOURNEY UNITED METHODIST CHURCH:
Councilor Hall moved the adoption of a resolution calling a public hearing June 1,
2020, commencing at 7:35 P.M., local time, to consider the application of MVAH
FOR A ZONE CHANGE for the construction of two 3-story 24 unit apartment buildings, including associated parking and site improvements, located at 8396 Morgan Rd., Tax Map No. 060.-01-05.1. Motion was seconded by Councilor Hess.
Ayes – 7 and Noes – 0. Motion Carried.
ONONDAGA COUNTY COMMUNITY DEVELOPMENT FUNDS – 2020 (CPH):
Councilor Meaker moved the adoption of a resolution calling a public hearing June
1, 2020, commencing at 7:38 P.M., local time, to solicit from Town of Clay residents their comments and input regarding the use of funds by the Town of Clay with respect to the applications for funding filed with ONONDAGA COUNTY COMMUNITY DEVELOPMENT for the year 2020. Motion was seconded by Councilor Pleskach.
Ayes – 7 and Noes – 0. Motion Carried.
Local Law No. 3 of the Year 2020 (CPH) – One Year Temporary Moratorium:
Whereas, the Town of Clay has received several applications for new commercial
solar operations and solar utility substations within the Town, and, REGULAR MEETING OF THE TOWN BOARD – May 4th , 2020 Town of Clay

Whereas, the Town does not currently have a comprehensive Town Policy or
applicable Town Code provisions to help guide the Town when determining proper land use considerations associated with the request, and,
Whereas, the Town recognizes the need to study the matter further and develop a
comprehensive policy and Code provisions, we hereby:
Councilor Pleskach moved the adoption of a resolution calling a public hearing on
June 1, 2020, commencing at 7:41 P.M., local time, to consider proposed LOCAL LAW NO. 3 OF THE YEAR 2020 enacting a one-year Temporary Moratorium on the consideration, approval, and development of any and all commercial solar array installations and commercial solar utility substations within the Town of Clay for a period of one (1) year from the active date of the Local Law, or sooner if new legislation amending the policy or Code of the Town of Clay addressing commercial solar array permitting and installations is enacted. The purpose of this Local Law will be to stay all actions until the presentation/passage of amended Town Policy and Code provisions dealing with proposed new commercial solar utility substations are approved. It is the intent of the Local Law to specifically exempt existing applications as of the date of the public hearing as well as any and all non- commercial residential solar applications. Motion was seconded by Councilor Meaker.

Local Law No. 4 of the Year 2020 (CPH) – (amending) Section 230-14 D:
Councilor Young moved the adoption of a resolution calling a public hearing June 1,
2020, commencing at 7:44 P.M., local time, to consider proposed LOCAL LAW NO. 4 OF THE YEAR 2020 amending Section 230-17 D. (2)(b) by adding item [10] Public Self-Storage Facility to the I-2 District to the Code of the Town of Clay. Motion was seconded by Councilor Meaker.
