The meeting was called to order by Supervisor Ulatowski at 7:30 P.M. All present joined in the Pledge of Allegiance.
Approval of Minutes:
Councilor Hess made a motion to approve the minutes of the September 4, 2019
meeting. Motion was seconded by Councilor Hall.
Ayes — 6 and Noes — 0 and 1 - Abstaining. Councilor Pleskach abstained due to his
absence at that meeting. Motion carried.
Cancellation and/or requested adjournments.
Supervisor Ulatowski said that item number 7 will be adjourned at the request of the applicant.
Correspondence:
Supervisor Ulatowski said that he had received from the Comptroller the Auditor _ report for the year ending December 31, 2018 consisting of Regulatory Financial - Statements and Agreed Upon Procedures Report and they have been distributed to the Town Board and have been filed with the Town Clerk.
REGULAR MEETING OF THE TOWN BOARD - September 16*4, 2019 Town of Clay
Supervisor Ulatowski asked if anyone wished to address the Board on any items not on the agenda.
Ronald Verwij of Peppermill Lane asked about a parcel on Taft Road across from Wegmans. He said that there have been some heavy equipment parked there for several years. Supervisor Ulatowski said that he would reach out to the property owner. Mr. Verwij said that they have not been moved and weeds are growing around them. The Supervisor reiterated that he would reach out to the owner.
Zone Change (PH/Adj.) —- Town Board Case # 1141 - Wetzel Road Zone Change: :
A public hearing to consider a Change of Zone at the request of the Town of Clay from I-1 Industrial District to R-40 One-Family Residential District on properties located on Weitzel Road. The properties of which are the subject of this change of zone are as follows: 4521 Wetzel Road - Tax Map No. 082.-01-23.0; 4529 Wetzel Road - Tax Map No. 082.-01- 22.0; 4555 Wetzel Road - Tax Map No. 082.-01-17.0; 4561 Wetzel Road - Tax Map No. 082.- 01-16.0; 4567 Wetzel Road - Tax Map No. 082.-01-15.0 & 4577 Wetzel Road - Tax Map No. 082.-01-13.0. (Adjourned to this date and time from the August 19, 2019 Town Board Meeting) was opened by the Supervisor Ulatowski.
Supervisor Ulatowski said that he would like to close the public hearing and asked if there was anyone present for the hearing. Jeff Fisher of 4577 Wetzel Road said that he had purchased the property that was listed as residential and is unable to obtain any building permits because it is a nonconforming use without getting a Zone Change. Supervisor Ulatowski said that he wants to close the public hearing and work to make this process more flexible and smooth. Councilor Young sought clarification and a brief discussion ensued. Supervisor Ulatowski closed the public hearing.
Special Permit (CPH) - Town Board Case # 1142 - DG NEW YORK CS, LLC: Councilor Bick mad a motion to adjourn the public hearing to consider the application of DG NEW YORK CS, LLC for a UTILITY SUBSTATION SPECIAL PERMIT pursuant to Section 230-27 I. (2) (e) to allow for a solar energy storage facility located at 4863 Ver Plank Road, Tax Map Nos. 030.-01-05.1 & 030.-01-03.0. (Adjourned to this date and time from the September 4, 2019 Town Board Meeting), at the request of the applicant to October 7, 2019 at 7:35 P.M. Motion was seconded by Councilor Hess.

Appointment — Board of Assessment Review:
Councilor Meaker moved the adoption of a resolution re-appointing Mary Lou DesRosiers
to the Board of Assessment Review for a term of five years. Said term to expire September 30, 2024. Motion was seconded by Councilor Young.
Ayes — 7 and Noes — 0. Motion carried.
Councilor Meaker moved the adoption of a resolution adopting the Harassment Prevention
Policy, including Sexual Harassment for the year 2020. Motion was seconded by Councilor Hall.

Zone Change (CPH) Special Joint Meeting - TC SYRACUSE DEVELOPMENT

Councilor Bick moved the adoption of a resolution calling a Special Meeting of the Town
Board of the Town of Clay to be held at Liverpool High School Auditorium, 4338 Wetzel Road, Liverpool, New York 13090 on Monday, September 30*, 2019 from 6:00 p.m. to 9:00 p.m. to consider the application of TC SYRACUSE DEVELOPMENT ASSOCIATES,
AJEMIAN PROPERTIES, LLC for a ZONE CHANGE from REC-1 Recreational District to I-1 Industrial District to develop a warehouse distribution facility on land located at 7211 and 7219 Morgan Road, Tax Map 114.-01-02.3. On that date and time a Joint Public Hearing will also be held. Motion was seconded by Councilor Hess.

Councilor Bick moved the adoption of a resolution calling a public hearing to be held at
Liverpool High School Auditorium, 4338 Wetzel Road, Liverpool, New York 13090 on Monday, September 30‘, 2019 from 6:00 p.m. to 9:00 p.m., local time, to consider the application of TC SYRACUSE DEVELOPMENT ASSOCIATES, LLC AND RONALD H.
LLC for a ZONE CHANGE from REC-1 Recreational District to I-1 Industrial District to develop a warehouse distribution facility on land located at 7211 and 7219 Morgan Road, Tax Map No. 114.-01-02.3. This resolution also formally refers the zone change request to the Town Of Clay Planning Board for a recommendation pursuant to Section 230-24(c)(3)(d) of the Town Code. The meeting and public hearing on September 30‘, 2019 will be a special joint meeting between the Town Board and the Planning Board. Motion was seconded by Councilor Hess.

Appointment — Assessor (correction):
Councilor Young moved the adoption of a resolution correcting the appointment of Rob Bick
as the Assessor of the Town of Clay. Said term to expire *September 30, 2025. Motion was seconded by Councilor Bick. (*Note: this was corrected from the September 4, 2019 Town Board Meeting which incorrectly stated term to end 12/31/2025.) Motion was seconded by Councilor Bick.
