The meeting was called to order by Deputy Supervisor Bick at 7:30 P.M. All

present joined in the Pledge of Allegiance.

Approval of Minutes:

Councilor Bray made a motion to approve the minutes of the November 9th, 2016

meeting. Motion was seconded by Councilor Young.

Ayes – 4 and Noes – 0 and 1- Abstaining. Motion carried. Councilor Hess

abstained due to his absence at that meeting.

Cancellation and/or requested adjournments.

Deputy Supervisor Bick said that item numbered 10 will be adjourned to February 6, 2017 at the request of the applicant. He continued that item numbered 11 has been withdrawn by the applicant.

Correspondence:

Deputy Supervisor Bick asked if anyone wished to address the Board on any items not on the agenda. There was no response.

R-16-201 ZONE CHANGE (SEQR) – Town Board Case # 1100 - JAMES DONEGAN (NYS Route 31):

Councilor Hess moved the adoption of a resolution that the application for

JAMES DONEGAN FOR A ZONE CHANGE from RA-100 Residential Agricultural to NC-1 Neighborhood Commercial to allow for neighborhood commercial use located on State Route 31, Tax Map No. 020.-01-05.4; consisting of approximately 1.07± acres of land is an unlisted action with a completed EAF and involves no other permit granting agency outside the Town. The proposed project will not have a significant effect on the environment and therefore does not require the preparation of an EIS. Motion was seconded by Deputy Supervisor Bick.

Ayes – 5 and Noes – 0. Motion carried.

Councilor Young moved the adoption of a resolution authorizing the installation

of three (3) fire hydrants in the Clay Consolidated Water Supply District and authorizing the Supervisor to execute the OCWA fire hydrant application. (Country Meadow Subdivision, Section No. 1). Motion was seconded by Councilor Bray.

R-16-206 Appointment - CLAY VOLUNTEER FIRE DEPARTMENT, INC.:

Councilor Young moved the adoption of a resolution approving the appointment

of Jim Gracievski and Mariah Hunter as volunteer members of the CLAY VOLUNTEER FIRE DEPARTMENT, INC. Motion was seconded by Councilor Bray.

R-16-207 Organizational Meeting for the Town of Clay:

Deputy Supervisor Bick moved the adoption of a resolution cancelling the

Monday, January 2, 2017 Organizational and Regular Town Board Meetings for the Town of Clay (New Year’s Day Observance) and rescheduling same to Wednesday, January 4, 2017, commencing at 7:00 P.M., local time, REGULAR MEETING OF THE TOWN BOARD – December 5th , 2016 Town of Clay

4 prior to the Regular Town Board Meeting. Motion was seconded by Councilor Bray.

Ayes – 5 and Noes – 0. Motion carried.

R-16-208 Meeting Date Change:

Deputy Supervisor Bick moved the adoption of a resolution cancelling the

January 16, 2017 Town Board Meeting and rescheduling same to Wednesday, January 18, 2017, commencing at 7:30 P.M., local time, due to the Martin Luther King Holiday. Motion was seconded by Councilor Hess.

Ayes – 5 and Noes – 0. Motion carried.

R-16-209 Meeting Cancellation:

Deputy Supervisor Bick moved the adoption of a resolution cancelling the

February 20, 2017 Town Board Meeting, due to President’s Day and due to the annual Association of Towns meeting. Motion was seconded by Councilor Bray.

R-16-210 AUDIT – Judicial (2015):

Deputy Supervisor Bick moved the adoption of a resolution that the Town of Clay

does hereby accept the Judicial Audit of the Town for the Fiscal Year ended December 31, 2015. Motion was seconded by Councilor Bray.

Deputy Supervisor Bick moved the adoption of a resolution accepting the Town

Audit for the Fiscal Year ended December 31, 2015. Motion was seconded by Councilor Bray.

R-16-212 STORMWATER AND EDUCATION COMPLIANCE ASSISTANCE

PROGRAM:

Councilor Bray moved the adoption of a resolution supporting participation in the

Central New York Regional Planning & Development Board’s year 8

STORMWATER AND EDUCATION COMPLIANCE ASSISTANCE

PROGRAM and authorizing the Supervisor to act on behalf of the Town of Clay REGULAR MEETING OF THE TOWN BOARD – December 5th , 2016 Town of Clay

5 and execute any and all documents necessary with regard to said matters. In line with the recommendations of the CNY Stormwater Coalition Finance Committee, the CNY RPDB (Regional Planning & Development Board) has adopted a FLAT FEE STRUCTURE to simplify the municipal budgeting process. At $3,600.00 PER MUNICIPALITY, this rate reflects shared costs for common services provided equally to all participating municipalities regardless of size or population. The funds will be available to the Board no later than January 31, 2017 to complete the project, and a certified copy of this resolution will be prepared and sent to the Board no later than November 30, 2016. Motion was seconded by Deputy Supervisor Bick.

R-16-213 Special Permit (CPH) Town Board Case # 1104 - SYRACUSE BRICK HOUSE, INC. D/B/A SYRACUSE BEHAVIORAL HEALTHCARE:

Deputy Supervisor Bick moved the adoption of a resolution calling a public

hearing December 19, 2016, commencing at 7:35 P.M., local time to consider the application of SYRACUSE BRICK HOUSE, INC. D/B/A SYRACUSE BEHAVIORAL HEALTHCARE for a SPECIAL PERMIT to allow for a hospital/clinic, pursuant to Section 203-17 C.(2)(e)[8] located at 4567 Crossroads Park Drive, Tax Map No. 115.-01-19.1. Motion was seconded by Councilor Bray.

R-16-214 Zone Change (CPH) Town Board Case # 1105 – 8302 OSWEGO ROAD, LLC (ROBERT ALUZZO):

Councilor Hess moved the adoption of a resolution calling a public hearing

December 19, 2016, commencing at 7:38 P.M., local time to consider the application of 8302 OSWEGO ROAD, LLC (ROBERT ALUZZO) FOR A ZONE CHANGE FROM RA-100 Residential Agricultural to O-1 Neighborhood Office to allow for a proposed office building located at 8302 Oswego Road, Tax Map No. 054.-01-03.1 consisting of approximately .42± acres of land. Motion was seconded by Deputy Supervisor Bick.

R-16-215 Traffic & Vehicles – (Stop Signs) (CPH)- New Hope and New Hope North:

Councilor Young moved the adoption of a resolution calling a public hearing

December 19, 2016, commencing at 7:41 P.M., local time to consider the amendment of CHAPTER 211, TRAFFIC AND VEHICLES ORDINANCE of the Code of the Town of Clay, SECTION 211-12 “STOP INTERSECTIONS,” REGULAR MEETING OF THE TOWN BOARD – December 5th , 2016 Town of Clay

6 SCHEDULE IX (§211-42), of the Town of Clay Municipal Code to designate and provide for THREE (3) STOP SIGNS to be installed at the intersection of New Hope and New Hope North to make a three-way stop; and the installation of the necessary signs therefore. Motion was seconded by Councilor Bray.

R-16-216 LOCAL LAW NO. 1 OF THE YEAR 2017 (amending) CHAPTER 230 “ZONING” (CPH) :

Councilor Bray moved the adoption of a resolution calling a public hearing

December 19, 2016, commencing at 7:44 P.M., local time to consider proposed LOCAL LAW NO. 1 OF THE YEAR 2017 amending CHAPTER 230 “ZONING” of the Town Code to amend §230-22 Signs by amending §230- 22C.(1) (c) [1] [a] [1] adding “Or uses” after ‘Permitted zones’ and adding at the end of the paragraph “for use by Emergency Vehicle Stations as defined in the Zoning Code,” and to be included in the Town of Clay Municipal Code. Motion was seconded by Councilor Hess.
