The meeting was called to order by Supervisor Ulatowski at 7:30 P.M. All present joined in the Pledge of Allegiance.

Approval of Minutes:

Councilor Rowley moved to Approve the Minutes of the May 19th, 2014 Town Board Meeting. Motion was seconded by Councilor Bick.

Ayes-7 and Noes-0. Motion carried.

Supervisor Ulatowski said that the McFarland Development – Zone Change (TB Case #1060) is adjourned. He added that the Town Board is waiting for extra copies of the map as requested in the previous meeting for the Riccelli Excavation Permit and that no decision will be forthcoming at this time.

Supervisor Ulatowski asked if anyone wished to address the Town Board on any items not on the agenda.

R-14-87 Agreement - LIVERPOOL CENTRAL SCHOOL DISTRICT & TOWN OF CLAY:

Councilor Bick moved the adoption of a resolution authorizing the Supervisor to

execute a LEASE AGREEMENT between the LIVERPOOL CENTRAL SCHOOL DISTRICT and the TOWN OF CLAY with regards to the use of the school’s facilities for the Town’s Athletic Sports Programs for the current year which shall extend from June 17, 2014 to August 30, 2015*, at a cost of approximately $2,958.00. Motion was seconded by Councilor Rowley.

Ayes-7 and Noes-0. Motion carried.

R-14-88 Appointment - CLAY VOLUNTEER FIRE DEPARTMENT, INC.:

Councilor Young moved the adoption of a resolution approving the appointment of

Chris Baublitz, Richard Beckley Jr., Joshua Hildreth, Justin Hildreth, Fay Lamb, Paul Richards Jr. and John Wieczorek as volunteer members of the MOYERS CORNERS FIRE DEPARTMENT, INC. – STATION 1; Joshua Cumings, Jonathan Gower, Jonathan Hart, Mariah Hunter, Nicholas Orcutt, Steven Picco, John Waldon Jr. and Karlil Williams as volunteer members of the MOYERS CORNERS FIRE DEPARTMENT, INC – STATION 2; and Alexis Kwiatkowski as a volunteer member of the MOYERS CORNERS FIRE DEPARTMENT, INC – STATION 3. Motion was seconded by Councilor Edick.

REGULAR MEETING OF THE TOWN BOARD – June 2nd, 2014 Town of Clay

3 R-14-89 Project/Warranty, Deed etc. - THE FARMSTEAD SUBDIVISION SECTION NO. 2:

Councilor Edick moved the adoption of a resolution accepting a Warranty Deed,

Dedication, Application and Release of damages for the roads in Section Two (2) located within THE FARMSTEAD SUBDIVISION SECTION NO. 2; from MAPLE ROAD ASSOCIATES, INC., (Weller Hall Place, Lepinske Farm Place and Mediator Way all having permeable shoulders). Motion was seconded by Councilor Bick.

Ayes-7 and Noes-0. Motion carried.

R-14-90 Project/Securities (posting). - THE FARMSTEAD SUBDIVISION SECTION NO. 2:

Councilor Bray moved the adoption of a resolution that the Town of Clay having

conducted public hearings to consider the construction and acquisition of the sewer, drainage, water supply and lighting facilities located within THE FARMSTEAD SUBDIVISION SECTION NO. 2, (The Farmstead Sewer District, Contract No. 1; The Farmstead Drainage District, Contract No. 1; The Farmstead Lighting District, Contract No.1) and the construction of said facilities having been completed in accordance with the Plans and Specifications thereof; The Town Engineers having certified that the facilities have been satisfactorily completed and that the developer post the following security as shown under correspondence by the Town Engineers’ under date of May 23, 2014: Overland Drainage Facilities - $10,000.00; Maintenance Guarantee - $25,309 ($16,014 Sewer and $9,295 Drainage); Highway - $51,380; Monument Deposit - $1,350; Parkland Contributions - $13,500; and any other unpaid fees that may be owed by the Town of Clay for engineering, legal and/or administrative fees; and further contingent upon the developer having complied with all the requirements set forth in an Agreement between the Town of Clay and MAPLE ROAD ASSOCIATES, INC., that the Town accept title to such facilities. Motion was seconded by Councilor Weaver.

R-14-91 Project/Easement - THE FARMSTEAD SUBDIVISION SECTION NO. 2:

Councilor Rowley moved the adoption of a resolution accepting easements for sewer

facilities located within THE FARMSTEAD SUBDIVISION SECTION NO. 2, (The Farmstead Sewer District, Contract No. 1) all as shown on a Final Plan prepared by Ianuzi & Romans Land Surveying, P.C., dated June 27, 2013, last revised May 22, 2014. Motion was seconded by Councilor Bick.

REGULAR MEETING OF THE TOWN BOARD – June 2nd, 2014 Town of Clay

4 R-14-92 Sewer Lateral Connection - SIKH Foundation of Syracuse, Inc.:

Councilor Rowley moved the adoption of a resolution authorizing a sewer lateral

connection, pursuant to the written request of the SIKH Foundation of Syracuse, Inc. (the property owner), to a Town of Clay sanitary sewer manhole within the Woodard Sewer District, Extension No. 4 for servicing an existing building located at 4632 Wetzel Road, Tax Map No. 087.-01-10.0. The cost of construction will be at no cost to the Town of Clay. The property owner agrees to pay all costs (Town and private) associated with the sanitary sewer connection as well as the Town of Clay Operation and Maintenance charges as annually assessed for *three units per acre and the County Sanitary District charges. The property owner further agrees to pay all annual Town and County charges thereafter.

Ron DeTota, Town Engineer pointed out that there is a correction* in the agenda and it should have read three (3) units per acre (corrected). Motion was seconded by Councilor Edick.

R-14-93 Special Permit (CPH) - Town Board Case # 1063- MCDONALD'S CORPORATION AND COR ROUTE 31 COMPANY, LLC:

Councilor Young moved the adoption of a resolution Calling a Public Hearing June

16, 2014, commencing at 7:35 P.M., local time, to consider the application of MCDONALD'S CORPORATION AND COR ROUTE 31 COMPANY, LLC for a SPECIAL PERMIT pursuant to section 230-13A. (2) (e) to remodel the building and improve the drive-thru of the existing restaurant located at 3869 State Route 31, Tax Map No. 021.-01-13.1. Motion was seconded by Councilor Weaver.

Ayes-7 and Noes-0. Motion carried.

R-14-94 Special Permit (CPH) - Town Board Case # 1064- SHARKEY'S ECLECTIC SPORTS LOUNGE, LLC:

Councilor Weaver moved the adoption of a resolution Calling a Public Hearing June

16, 2014, commencing at 7:38 P.M., local time, to consider the application of SHARKEY'S ECLECTIC SPORTS LOUNGE, LLC for a SPECIAL PERMIT on vacant land pursuant to section 230-13A. (2) (e) for recreational use on property located at 7240 Oswego Road, Tax Map Nos. 114.-01-37, 114.-01-32 and 114.-01- 34. Motion was seconded by Councilor Bick.

R-14-95 Zone Change (CPH)- Town Board Case # 1062- ANDREW AUGISTINOS:

Councilor Young moved the adoption of a resolution Calling a Public Hearing July 21,

2014, commencing at 7:35 P.M., local time, to consider the application of ANDREW AUGISTINOS FOR A ZONE CHANGE from R-10 One Family Residential

5 District to O-1 Neighborhood Office District to allow for a small office located at 4976 West Taft Rd, Tax Map No. 116.-01-02.0. Motion was seconded by Councilor Rowley.

R-14-96 Bid Advertisement (A)- BAYBERRY SUBDIVISION POROUS PAVEMENT PROJECT:

Councilor Bick moved the adoption of a resolution authorizing the advertisement of

bids for the BAYBERRY SUBDIVISION POROUS PAVEMENT PROJECT (HUMMINGBIRD AND INDIGO PATHS). Said bids to be received at the office of the Town Clerk, Town of Clay Town Hall located at 4401 New York State Route 31, Clay, New York 13041, until two (2) o'clock P.M., local time, on June 19, 2014.

Motion was seconded by Councilor Edick.

Ayes – 6 and Noes – 1. Motion carried. Councilor Weaver opposed.
