At the Regular Meeting of the Town Board, Town of Clay, Onondaga County, held at the Town Hall, Clay, New York on the 18th of April, 2011 at 7:30 P.M., there were:

The meeting was called to order by Supervisor Ulatowski at 7:30 P.M. All present joined in the Pledge of Allegiance.
Approval of Minutes:
Councilor Edick moved the adoption of a resolution approving the Minutes of the
Regular Town Board Meeting held on April 4, 2011. Motion was seconded by Councilor Bick.
Ayes-7 and Noes-0. Unanimously carried.
Energy Grant Committee Quarterly Report.
Supervisor Ulatowski began by explaining that the Town of Clay is pursuing more green initiatives and has just completed a half million dollar rehabilitation project on the highway garage. The Town received money for this project through the Grant process and is in the process of pursuing more funds to further the progress the Town has made. To date the project includes a more energy efficient roof and heating system.

2 Dorothy Heller, Town Historian addressed the room and began by explaining that she had just come back from the Historians Conference where the topic was the Civil War. At the conference Ms. Heller learned that New York State sent the greatest number of soldiers to the Civil War. Ms. Heller continued that she was trying to find information on former Town of Clay residents that had partaken in the war. She ended by stating that she had handouts regarding this search.
Supervisor Ulatowski thanked Ms. Heller adding what a nice project this is.
Russ Mitchell stated that there is an increase of litter in the town. The Post Standard is throwing advertisements in bags into resident driveways. Mr. Mitchell said that he called the Post Standard and that it may or may not make a difference. Supervisor Ulatowski agreed adding that the Yellow Books being dropped at the curb are also a mess.
Commissioner Territo said that he has contacted the Yellow Book and will follow up with a letter to both Yellow Book and The Post Standard to try to correct the problem.

Zone Change (PH) - Town Board Case # 1025 - AFFORDABLE SENIOR
ALISON G. POST and LIVERPOOL CENTRAL SCHOOL:
A public hearing to consider the application of AFFORDABLE SENIOR
ALISON G. POST and LIVERPOOL CENTRAL SCHOOL for a change of zone from RA-100 Residential Agricultural District and HC-1 Highway Commercial District to R-SR Senior Residence District on part of 8565± Morgan Road, part of Tax Map No. 055.-01-14.1 and part of Tax Map No. 055.-01- 13.1 being vacant property on Morgan Road was opened by the Supervisor. Proof of publication and posting was furnished by the Town Clerk.
Councilor Edick made a motion to adjourn this public hearing to May 16, 2011 at
7:38 PM. Motion was seconded by Councilor Bray.
Ayes-7 and Noes-0. Motion carried.
REGULAR MEETING OF THE TOWN BOARD - April 18, 2011 Town of Clay
3 Special Permit (PH) - Town Board Case # 1026 - MARCOS DIEGO:
A public hearing to consider the application of MARCOS DIEGO, for a SPECIAL
OF PLANTS on property located at 4511 Buckley Road, Liverpool, New York, Tax Map No. 087.-01-28.0 was opened by the Supervisor. Proof of publication and posting was furnished by the Town Clerk.
Wayne Jarvis appeared on behalf of the applicant. Mr. Jarvis began by stating that the applicant is out of the country at this time and that Mrs. Diego were there. Mr. Jarvis stated that the applicant is proposing to sell flowers on the side of the road that he grows on his property. He continued that Mr. Diego plans to design a circular drive as to not obstruct traffic on Buckley Road therefore having minimal impact.
Supervisor Ulatowski asked if the applicant will grow perennials and he will. He asked if the applicant is proposing a sign and they are not. He asked about the parking and Mrs. Diego said that there is enough parking for 6-7 cars. He also asked about the season. Mrs. Diego said that the season will be from May through the end of August.
Supervisor Ulatowski asked if the Board had any questions or comments. Councilor Bick stated that he thought that this was an excellent use for this property.
Supervisor Ulatowski opened it up to the residents. Russ Mitchell said that he was familiar with the property and that he had no objections.
Supervisor Ulatowski asked if there were any further comments or questions and there were none. All persons wishing to be heard having been heard the hearing was closed.
Appointment (A) MARRIAGE OFFICER:
Councilor Bick moved the adoption of a resolution appointing JILL HAGEMAN-
CLARK, as a MARRIAGE OFFICER for the Town of Clay, pursuant to Section 11 of the New York State Domestic Relations Law, effective immediately. Said appointment expires December 31st, 2011. Motion was seconded by Councilor Bray.
Ayes-7 and Noes-0. Unanimously carried.
REGULAR MEETING OF THE TOWN BOARD - April 18, 2011 Town of Clay
4 Purchase/Highway - 2011 WESTERN STAR 4900FA TANDEM AXLE PLOW/DUMP TRUCK:
Councilor Weaver moved the adoption of a resolution approving the purchase of
TRUCK FOR USE BY THE HIGHWAY DEPARTMENT for a sum not to exceed Two Hundred Thousand and 00/100 ($200,000.00) Dollars, under NYSOGS Contract Award 2011, Contract # PC62376, (Contractor - Tracey Road Equipment). Motion was seconded by Councilor Rycraft.
Ayes-7 and Noes-0. Unanimously carried.
Bond Resolution/Purchase/Highway - 2011 WESTERN STAR 4900FA TANDEM AXLE PLOW/DUMP TRUCK:
Councilor Weaver moved the adoption of a Bond Resolution in the amount of
$200,000.00 for the purchase of ONE (1) 2011 WESTERN STAR 4900FA
DEPARTMENT. Motion was seconded by Councilor Rycraft.
Ayes-7 and Noes-0. Unanimously carried.
The meeting was adjourned at 7:53 P.M. upon motion by Councilor Bray and seconded by Councilor Bick. Ayes-7 and Noes-0. Motion carried.
