February 2, 2009 At the Regular Meeting of the Town Board, Town of Clay, Onondaga County, held at the Town Hall, Clay, New York on the 2nd of February, 2009 at 7:30 P.M., there were:

PRESENT:

ABSENT:

Robert L. Edick Deputy Supervisor/Councilor The meeting was called to order by Supervisor Ulatowski at 7:30 P.M. All present joined in the Pledge of Allegiance.

Approval of Minutes:

Councilor Bray moved the adoption of a resolution approving the Minutes of the

Regular Town Board Meeting held on the January 21, 2009. Motion was seconded by Councilor Johnson.

Ayes-5 and Noes-0. Councilor Bick abstained, as he was absent from that

meeting. Motion carried.

Cancellations and/or requested adjournments:

The Supervisor stated that due to the Post Standard's change in policy as to the receipt and publication of legal notices, the public hearings called at the January 21st, 2009 Town Board Meeting for February 2nd, 2009 will not be held. The Town Board will reschedule such hearings.

Correspondence/Other Business:

Supervisor Ulatowski asked if anyone wanted to speak to the board. REGULAR MEETING OF THE TOWN BOARD - February 2, 2009 Town of Clay

Kaitlyn Paitlin, a resident from Cairns Trail addressed the board. Ms. Paitlin said that she is a Cicero-North Syracuse student and participates in the activities that are provided by the Can-Teen. She read a letter that she had prepared, thanking the Can-Teen for helping her to achieve many things and by giving support, further adding that she has received three scholarships for college as a result. Ms. Paitlyn concluded by thanking the Town for supporting this program. Supervisor Ulatowski asked Ms. Paitlin to explain what the Can-Teen is as there are people in the community that are not familiar with this program. Ms. Paitlyn said that the Can-Teen provides teens from13 to 18 years old, with the essential needs and counseling.

Jennifer Vissik of Amalfi Drive and Alexis Shelton of Steelwood Lane said that they had also benefitted from the services provided by the Can-Teen. Zone Change - (SEQR) - Town Board Case # 993 - GROUP ONE DEVELOPMENT, LLC and DAVID A. BARKLEY and ELEANOR G. BARKLEY:

Councilor Bray moved the adoption of a resolution that the application of GROUP

ONE DEVELOPMENT, LLC and DAVID A. BARKLEY and ELEANOR G.

BARKLEY for a change of zone from RA-100 Residential/Agricultural District to R-15 One-Family Residential, for property consisting of approximately 10.6± acres, located on the north side of Maple Road, 1435’ ± westerly of Gatewood Drive, Tax Map No. 074.-01-17.2 is an unlisted action with a completed EAF and involves no other permit granting agency outside the Town. That the proposed project will not have a significant effect on the environment and therefore does not require the preparation of an EIS. (Recommendation by the Commissioner of Planning & Development is that said project does not require the preparation of an EIS). Motion was seconded by Councilor Rycraft.

Ayes-6 and Noes-0. Motion carried.

Zone Change - (A) - Town Board Case # 993 - GROUP ONE DEVELOPMENT, LLC and DAVID A. BARKLEY and ELEANOR G. BARKLEY:

Councilor Johnson moved the adoption of a resolution approving the application

of GROUP ONE DEVELOPMENT, LLC and DAVID A. BARKLEY and ELEANOR G. BARKLEY for a change of zone from RA-100 Residential/Agricultural District to R-15 One-Family Residential, for property consisting of approximately 10.6± acres, located on the north side of Maple Road, 1435’ ± westerly of Gatewood Drive, Tax Map No. 074.-01-17.2. Motion was seconded by Councilor Bray.

Special Permit - Gas Pump Island -(CPH) - Town Board Case # 997, WALRUS, LLC:

Councilor Bick moved the adoption of a resolution calling a public hearing March

2nd, 2009 commencing at 7:35 P.M., local time, to consider the application of WALRUS, LLC, for a SPECIAL PERMIT FOR GAS PUMP ISLANDS AT THE PROPOSED NICE N’ EASY CONVENIENCE STORE to be located at the southeast corner of Henry Clay Boulevard and New York State Route 31, (part of Tax Map No.061.-01-16.1). Motion was seconded by Councilor Bray.

Ayes-6 and Noes-0. Motion carried.

Special Permit - Drive Thru- Town Board Case # 998 (CPH) -WALRUS, LLC:

Councilor Weaver moved the adoption of a resolution calling a public hearing

March 2nd, 2009, commencing at 7:38 P.M., local time, to consider the application of WALRUS, LLC, for a SPECIAL PERMIT FOR a DRIVE THRU AT A PROPOSED BANK to be located at the southeast corner of Henry Clay Boulevard and New York State Route 31, (part of Tax Map No. 061.-01-16.1). Motion was seconded by Councilor Johnson.

Ayes-6 and Noes-0. Motion carried.

Zone Change (CPH)- Town Board Case # 999, RICHARD F. CHRISTIANA:

Councilor Bick moved the adoption of a resolution calling a public hearing March

2nd, 2009, commencing at 7:41 P.M., local time to consider the application of RICHARD F. CHRISTIANA, for a change of zone from O-1 Neighborhood Office District to NC-1 Neighborhood Commercial District on property located at

Oswego Road, (Tax Map Nos. 081.-12-42.1 and 081.-12-43.0) Motion was seconded by Councilor Bray.

Ayes-6 and Noes-0. Motion carried.

Budget/Water Department (CPH)- Rate Increase:

Councilor Rycraft moved the adoption of a resolution calling a public hearing

March 16th, 2009, commencing at 7:38 P.M., local time, to reopen the 2009 TOWN OF CLAY WATER BUDGET in order to discuss the rate increase to the

REGULAR MEETING OF THE TOWN BOARD - February 2, 2009 Town of Clay

Town of Clay by Onondaga County Water Authority and to consider a RATE INCREASE accordingly for Residential (15%) and Industrial rates, (15%); due to the increases charged the Town of Clay by Onondaga County Water Authority. Motion was seconded by Councilor Bick.

Ayes-6 and Noes-0. Motion carried.

Zone Change (Adj) - Town Board Case #995, DONALD GRIMSLEY and GRIMSLEY PROPERTIES, LLC:

Councilor Bray moved the adoption of a resolution adjourning the public hearing

to March 2rd, 2009, commencing at 7:53 P.M., local time, to consider the application of DONALD GRIMSLEY and GRIMSLEY PROPERTIES, LLC, for a change of zone from R-10 One Family Residential District to O-1 Neighborhood Office District on property located at 5328 and 5332 West Taft Road, Tax Map Nos.117.-10-02.1 and 117.-10-03.1. Adjourned to this date and time at the January 21st, 2009 Town Board Meeting. Motion was seconded by Councilor Bick.

Councilor Johnson moved the adoption of a resolution adjourning the public

hearing to March 2nd, 2009, commencing at 7:56 P.M., local time, to consider the application of JOSEPH JANOWSKI for a SPECIAL PERMIT TO OPERATE A

MEDICAL OFFICE IN AN 0-2 OFFICE ZONE ON PROPERTY LOCATED AT 8086

Oswego Road, Tax Map No. 068.-07-17.0. Adjourned to this date and time at the January 21st, 2009 Town Board Meeting. Motion was seconded by Councilor Bray.

Councilor Johnson moved the adoption of a resolution calling a public hearing

March 2nd, 2009, commencing at 7:47 P.M., local time, to consider the application of THE ESTATE OF DONALD ALT for a change of zone from R-2F Two Family Residential District to R-APT Apartment District on property located at 8079 Stearns Road, (Tax Map No.075.-02-02.1). Motion was seconded by Councilor Bray.

Councilor Johnson moved the adoption of a resolution calling a public hearing

March 2nd, 2009, commencing at 7:50 P.M., local time, to consider the application of 4-WARD SALES LLC, for A SPECIAL PERMIT TO ALLOW THE SALE OF MOTOR VEHICLES ON-SITE to be located at 4531 New York State Route 31 and Henry Clay Boulevard, (Tax Map No. 029.-01-10.1). Motion was seconded by Councilor Bick.

Special Permit (CPH) - Town Board Case # 1002, Gary Bell:

Councilor Weaver moved the adoption of a resolution calling a public hearing

March 16th, 2009, commencing at 7:35 P.M., local time, to consider the application of GARY BELL for a SPECIAL PERMIT TO OPERATE A COLLISON REPAIR FACILITY on property located at 7422 Oswego Road, (Tax Map No. 104.-03-10). Motion was seconded by Councilor Bray.

Ayes-6 and Noes-0. Motion carried.

Cluster Development -ELDAN HOMES, INC., THE ESTATES AT WILDFLOWER No action taken.
