The meeting was called to order by Supervisor Ulatowski at 7:30 P.M. All present joined in the Pledge of Allegiance.
Approval of Minutes:
Councilor Hess made a motion to approve the minutes of the October 15th , 2018
meeting. Motion was seconded by Councilor Bick.

REGULAR MEETING OF THE TOWN BOARD – November 7th, 2018 Town of Clay
2 Supervisor Ulatowski said that he would skip ahead to item number 16 on the agenda, the Local Law No. 1 of 2018, due to the advertised time of the public hearings.
Supervisor Ulatowski said that he would open all of the budget hearings at once. John Shehadi gave a brief overview of the four proposed budgets for 2019.
A public hearing to consider the adoption of the proposed 2019 Special Districts Budget for the Town of Clay was opened by the Supervisor; proof of publication and posting was furnished by the Town Clerk.
A public hearing to consider the adoption of the proposed 2019 Fire Protection Budget for the Town of Clay was opened by the Supervisor; proof of publication and posting was furnished by the Town Clerk.
A public hearing to consider the adoption of the proposed 2019 Uniform Water Budget for the Town of Clay was opened by the Supervisor; proof of publication and posting was furnished by the Town Clerk.
Adoption of the Proposed 2019 Preliminary Budget for the Town of Clay (PH):
A public hearing to consider the adoption of the proposed 2019 Preliminary Budget for the Town of Clay, as the annual budget was opened by the Supervisor; proof of publication and posting was furnished by the Town Clerk. Mr. Shehadi, Comptroller for the Town of Clay began by explaining that the Special Districts budget covers trash, brush, sewer, water and lighting for the 27 districts. He explained that the Town of Clay is in the fourth year of a five year trash contract and there is an increase scheduled for this year. Prior to the implementation of trash districts (15+ years ago) residents contracted with their own trash haulers; the cost then was double what residents will pay this year. Sewer and Drainage is basically a repair fund. The cost for sewer will be $20.00 and drainage will be $79.00 per home for the 2019 year. The lighting in the Town of Clay will increase due to the increasing rates from the supplier. The hydrant budget for the Town of Clay is $141,000.00 for 2019.

3 Supervisor Ulatowski asked if there were any questions or comments. Shannon Knapp asked if in the future copies could be provided before the meeting begins. Supervisor Ulatowski said that he would and asked the Clerk to make note. There being no additional questions or comments, the Supervisor closed the public hearing.
Mr. Shehadi continued that the Fire Budget includes 4 fire districts and part of the village. The Town of Clay provides a LOSAP (Length of Service Award Program) to eligible Fire Fighters. They must complete training and a certain number of hours of service each year to qualify for this retirement program. Mr. Shehadi explained that the Fire Departments have consistently worked to keep the cost down. Supervisor Ulatowski recognized some of the Fire Fighters present and thanked them for their care and dedication as volunteers to the Town. He added that he has worked on the budget process with each one and is thankful for their diligence in keeping their budgets low. Councilor Meaker thanked Mr. Shehadi for his work on the budget noting how tedious it can be.
Supervisor Ulatowski asked if there were any questions or comments; hearing none he closed the public hearing.
Mr. Shehadi explained that approximately 1/3 of the Town (6,000 out of 19,000 parcels) is served by the Town of Clay water. The Water Department will undergo a major renovation to the water meters that will in the long run save labor costs as well as capture a loss of consumption (5-10%) with the older units. This improvement will take 2-3 years to implement. There will be an increase to the residents served by Town of Clay water however they will still pay 35% less than those served by OCWA. Supervisor Ulatowski acknowledged the commitment to the residents and explained that the new equipment is state of the art, on par with OCWA.
Supervisor Ulatowski asked if there were any questions or comments; hearing none he closed the public hearing.
Mr. Shehadi concluded by explaining that the preliminary budget for 2019 includes increased funding for paving. Other increases will be for the highway and the general fund resulting in an increase of $6.36 a year based on a $100,000.00 home. Supervisor Ulatowski again thanked Mr. Shehadi and his staff for a great budget adding that this is an excellent commitment to the residents without decreasing services.

Stop Sign(s) (2) Capricorn Drive and Libra Lane (PH):
A public hearing to consider the amendment of CHAPTER 211, TRAFFIC AND VEHICLES ORDINANCE of the Code of the Town of Clay, SECTION 211-12 “STOP INTERSECTIONS,” SCHEDULE IX (§211-42), to designate and provide for TWO (2) ADDITIONAL STOP SIGNS to be installed at the intersection of Capricorn Drive and Libra Lane to make a three-way stop; and the installation of the necessary signs therefore was opened by the Supervisor; proof of publication and posting was furnished by the Town Clerk.
Supervisor Ulatowski asked who was present on behalf of this request. No one was present.
The Supervisor explained that comments had been provided by the Highway Superintendent in favor of the proposed Stop Signs.
The Town Constable said that there have not been any accidents in the past several years and was opposed to the proposed signs. The Supervisor said that the application stated that there is concern for the children playing. Several members of the Town Board suggested that they would like to review the intersection prior to making a decision. Supervisor Ulatowski concurred, adding that before the next meeting he would like the board members to go out and look at the intersection.
Councilor Pleskach made a motion to adjourn the public hearing to November 19,
2018 at 7:35 PM. Motion was seconded by Councilor Hess.

Councilor Meaker moved the adoption of a resolution approving and adopting the

Adoption of the 2019 Proposed Preliminary Budget for the Town of Clay (A):
Councilor Meaker moved the adoption of a resolution approving and adopting the
PRELIMINARY BUDGET as proposed, for the Town of Clay for the year 2019 as the TOWN OF CLAY BUDGET for the year 2019. Motion was seconded by Councilor Hess.

Local Law No. 1 of 2018 (D) – TO OVERRIDE THE TAX LEVY LIMIT ESTABLISHED IN GENERAL MUNICIPAL LAW SECTION 3-C:
Supervisor Ulatowski moved the adoption of a resolution denying the proposed
Local Law to be entitled “LOCAL LAW NO. 1 OF THE YEAR 2018 TO
MUNICIPAL LAW SECTION 3-C” to the code of the Town of Clay. Motion was seconded by Councilor Hess.
Ayes – 7 and Noes – 0. Motion carried.
Supervisor Ulatowski said that this provision will not be necessary again this year as the budget is once again below the 2% tax cap.
Bid (AWARD) - COLLECTION AND DISPOSAL OF BRUSH FOR CLAY BRUSH REMOVAL DISTRICT NOS. 2, 3 AND 4:
Councilor Hess moved the adoption of a resolution awarding a contract for
DISTRICT NOS. 2, 3 AND 4 within the Town of Clay to Superior Waste for a period of 3 Years having a pick-up frequency of weekly being the low bid of REGULAR MEETING OF THE TOWN BOARD – November 7th, 2018 Town of Clay
6 $567,962.56; said amount being the lowest responsible bid, and further authorizing the Supervisor to execute any and all documents therefore. Motion was seconded by Councilor Bick.

Bid (AWARD) - COLLECTION AND DISPOSAL OF BRUSH FOR CLAY BRUSH REMOVAL DISTRICT NOS. 5, 7 AND 8:
Councilor Hess moved the adoption of a resolution awarding a contract for
DISTRICT NOS. 5, 7, AND 8 within the Town of Clay to Superior Waste for a period of 3 Years having a pick-up frequency of weekly being the low bid of $576,261.62; said amount being the lowest responsible bid, and further authorizing the Supervisor to execute any and all documents therefore. Motion was seconded by Councilor Bick.
Ayes – 7 and Noes – 0. Motion carried.
Supervisor Ulatowski explained that the change of service from bi-weekly to weekly is favorable. He added that we are doubling the service for less. Dates will be forth coming on the post card as in the past.
Hydrant(s) (A) - The Farmstead, Section No. 4:
Councilor Hall moved the adoption of a resolution approving the installation of two
(2) fire hydrants in The Farmstead, Section No. 4, and authorizing the Supervisor to execute the revised OCWA fire hydrant application. Fire Hydrant Nos. 14398 & 14400, OCWA Project No. 9003949. (Maple Road Associates, Inc.). Motion was seconded by Councilor Hess.

Contract/ Agreement – Onondaga County Community Development:
Councilor Bick moved the adoption of a resolution approving a cooperation
agreement between Onondaga County Community Development and the Town of Clay for the purpose of undertaking essential community development and housing assistance activities of urban renewal and publicly assisted housing (HUD) Act for road reconstruction, and authorizing the Supervisor to execute the necessary document therefore. Motion was seconded by Councilor Pleskach.

REGULAR MEETING OF THE TOWN BOARD – November 7th, 2018 Town of Clay
7 Authorization - JUSTICE COURT ASSISTANCE PROGRAM:
Councilor Bick moved the adoption of a resolution authorizing Judge Gosch and
Judge Lauri to make the necessary applications for a grant from New York State for the JUSTICE COURT ASSISTANCE PROGRAM and the execution therefore. Motion was seconded by Councilor Pleskach.
Ayes – 7 and Noes – 0. Motion carried.
Ordinance 2018-03, CHAPTER 211, §211-29 “Parking of certain motor vehicles and trailers prohibited in residential districts” (No enforcement until October 1, 2019):
Councilor Pleskach moved the adoption of a resolution officially staying enforcement
and prosecution of the new trailer Ordinance 2018-03, CHAPTER 211, §211-29 C & D “Parking of certain motor vehicles and trailers prohibited in residential districts” until October 1, 2019 as discussed during the Local Ordinance enactment process, and further advising the Town Code Office and prosecutors of this action. Motion was seconded by Councilor Bick.

Councilor Pleskach reiterated that sections C & D will be added to the Ordinance.
