At the Regular Meeting of the Town Board, Town of Clay, Onondaga County, held at the Town Hall, Clay, New York on the 17th of January, 2018 at 7:30 P.M., there were:

The meeting was called to order by Supervisor Ulatowski at 7:30 P.M. All present joined in the Pledge of Allegiance. Supervisor Ulatowski said that for a few meetings he would begin by introducing the Town Board as there are several new members. Approval of Minutes:
Councilor Hess made a motion to approve the minutes of the January 3rd, 2018
meeting. Motion was seconded by Councilor Bick.

Supervisor Ulatowski began by explaining that County Legislator Rowley will be attending the second meeting of each month to explain what is happening, providing specifics on programs, decisions, and pending issues at the County level. Mr. Rowley explained that the County Legislature meets the second Tuesday of each month. He began by explaining that the legislature has had a very slow start and that Ryan McMahon will continue as Chairman. The Onondaga County Legislature will establish a non-partisan committee to redistrict.
Mr. Rowley continued by explaining that the County Sewer Department will be significantly increasing (more than double) the rates for sewer repairs. He added REGULAR MEETING OF THE TOWN BOARD – January 17, 2018 Town of Clay
2 that many of the towns in Onondaga County are searching for an alternative to contracting with WEP and he encourages this practice.
Mr. Rowley said that they are working to improve ethics issues by limiting “pay to play” a cooling off period of one year. They are also proposing an anti-nepotism initiative to limit elected officials hiring relatives, term limits and allowing the County Comptroller to audit departments.
Several of the Board members thanked Mr. Rowley for bringing this information to our attention.
Councilor Hess asked about the roads and the poor job of plowing that has been done on County roads. Mr. Rowley agreed, adding that he had heard that they ran out of salt.
Supervisor Ulatowski commented that he is outraged that the County can increase the sewer maintenance charges 80-240%. He stated that he has been in contact with other towns and that this Board will be looking for alternative services. The Supervisor concluded that the Town of Clay has not budgeted for such increases.

Special Permit (Withdrawn) Town Board Case # 1102 - MCDONALDS USA, LLC AND WEGMANS FOOD MARKETS, INC.:
McDonald’s application withdrawn, No action.
Special Permit (PH) Town Board Case # 1121 - DEVIN DALPOS LAKER DEVELOPMENT GROUP, LLC & AILEEN SCHMIDT: A public hearing to consider the application of DEVIN DALPOS LAKER
REGULAR MEETING OF THE TOWN BOARD – January 17, 2018 Town of Clay
3 PERMIT pursuant to Section 203-16C. (2) (E) [2] to allow for a Drive Thru for Starbucks, on vacant land located at 3820-3848 State Route 31, Tax Map No. 053.-01-19.1, consisting of approximately 6.049± acres of land, was opened by the Supervisor; proof of publication and posting was furnished by the Town Clerk.
Lisa Wennberg from Keplinger, Freeman Associates began by explaining they have received preliminary approval from the County Department of Transportation. She added that there are concerns that the crosswalk will continue over the split ingress/egress.
The direction of the drive-thru will be to the west and continuing to the south where the drive-thru will be located. She added that this will reduce any issues with stacking.
Ms. Wennberg went through the Standards of Proof, addressing each item.
Councilor Hess said that he likes the traffic flow and asked if there is a STOP sign. There is. Councilor Young asked them to speculate approximately how many cars. Ms. Wennberg responded that peak is 6AM to 12 PM. Councilor Young also asked if they would place DO NOT ENTER signs. Ms. Wennberg said that they will.
Supervisor Ulatowski asked Commissioner Territo if the applicant will be before the Planning Board. The Commissioner said that they will. Supervisor Ulatowski said that he would like them to review the drive thru at that time.
Councilor Bick made a motion to adjourn the public hearing to February 5, 2018 at
7:41 PM after review from the Planning Board. Motion was seconded by Councilor Hess.

TOWN ENGINEERS:
Councilor Hess moved the adoption of a resolution that C & S Engineers, Inc. be
retained by the Town of Clay to perform such services for the Town Board, Planning Board and Zoning Board of Appeals as necessary for a term of two (2) years. Motion was seconded by Councilor Bick.
Ayes – 7 and Noes – 0. Motion carried.
APPOINTMENT – Zoning Board of Appeals:
Councilor Young moved the adoption of a resolution reappointing Edward
Wisnowski as a member of the Zoning Board of Appeals. Said term to expire December 31, 2022. Motion was seconded by Councilor Hess. REGULAR MEETING OF THE TOWN BOARD – January 17, 2018 Town of Clay

Agreement - CENTRAL NEW YORK SOCIETY FOR THE PREVENTION OF CRUELTY TO ANIMALS:
Councilor Bick moved the adoption of a resolution authorizing the Supervisor to
enter into an Agreement on behalf of the TOWN OF CLAY with the CENTRAL
ANIMALS. Said agreement is a two quarter contract at a cost not to exceed $1,600 quarterly, with the option to renew an additional two quarters for the year 2018 for the treatment of animals. Motion was seconded by Councilor Pleskach.
Ayes – 7 and Noes – 0. Motion carried.
Councilor Young asked if this charge will include all animals. Supervisor Ulatowski explained that this will provide for cruelty services for all domestic animals.
The meeting was adjourned at 7:58 P.M. upon motion by Councilor Young and seconded by Councilor Bick.
