The meeting was called to order by Supervisor Ulatowski at 7:30 P.M. All present joined in the Pledge of Allegiance.

Approval of Minutes:

Councilor Rowley moved to approve the minutes of the May 4th, 2015 Minutes. Motion was seconded by Councilor Bray.

Ayes - 6 and Noes – 0. Motion passed.

Supervisor Ulatowski said that he knew of no cancellations or requests for adjournments.

Correspondence:

Supervisor Ulatowski asked if anyone wished to address the Town Board on any items not on the agenda. No one responded,

Supervisor Ulatowski then asked if Mr. Liberatore was present as Mr. Liberatore had brought up concerns/complaints regarding the snow plowing by the Town and independent contractors equally. The Supervisor stated that he had researched this and found that several departments had followed up on this.

R15-83 Zone Change (SEQR) – Town Board Case # 1077 - THE MUFALE LIMITED PARTNERSHIP:

Councilor Bick moved the adoption of a resolution that the application of THE

MUFALE LIMITED PARTNERSHIP FOR A ZONE CHANGE from R-7.5 One- Family Residential District to R-TH Townhouse District to allow for the construction of townhouses on vacant land located at 3946 State Route 31, on part of Tax Map No. 055.-01-01.1; consisting of approximately 10.926± acres of land, is an unlisted action with a completed EAF and involves no other permit granting agency outside the Town. The proposed project will not have a significant effect on the environment and therefore does not require the preparation of an EIS. Motion was seconded by Councilor Bick.

R15-84 Zone Change (A) – Town Board Case # 1077 - THE MUFALE LIMITED PARTNERSHIP:

Councilor Rowley moved the adoption of a resolution approving the application of

THE MUFALE LIMITED PARTNERSHIP FOR A ZONE CHANGE from R-7.5 One-Family Residential District to R-TH Townhouse District to allow for the construction of townhouses on vacant land located at 3946 State Route 31, on part of Tax Map No. 055.-01-01.1; consisting of approximately 10.926± acres of land. This resolution is strictly contingent upon the elimination of traffic access from Pine Gate to State Route 31 in substantial compliance with “Exihibit A”, Zone Change Site Plan A without road connect to Sutcliffe Drive, a map dated 3/25/2015 and prepared by Ianuzi and Romans. We also instruct the Planning Board to evaluate potential pedestrian access. Motion was seconded by Councilor Bick.

The resolution was put to a roll call vote and went as follows:

R15-85 Authorization (A) – Sewer Connection – James Workman:

Councilor Rowley moved the adoption of a resolution authorizing a sanitary sewer

connection, pursuant to the written request of James Workman, (the property owner), to the Town of Clay sanitary sewer pump station force main located at State Route 31 for servicing their business located at 4356 State Route 31 (Tax Map No. 059.- 01-13.1). 3 owner agrees to pay all costs (Town and private) associated with the sanitary sewer connection as well as the Town of Clay Operation and Maintenance charges as annually assessed for three units per developed acre and the County Sanitary District charges. The property is located near the Orange Commons Sewer District. The property owner further agrees to pay all annual Town and County charges thereafter. Motion was seconded by Councilor Bick.

R15-86 Authorization/Application (A) Youth Recreation Grant Funding for the year 2015:

Councilor Bick moved the adoption of a resolution authorizing the application for

funding for the New York State Office of Children and Family Services for the year 2015 in the amount of $6,284.00; and further authorizing the Supervisor to apply for and execute an Inter-Municipal Agreement with Onondaga County, on behalf of the Town of Clay, for Youth Recreation Grant Funding for the year 2015. Motion was seconded by Councilor Rowley.

R15-87 Authorization(A) – Lease Agreement - LIVERPOOL CENTRAL SCHOOL DISTRICT and the TOWN OF CLAY:

Councilor Bick moved the adoption of a resolution authorizing the Supervisor to

execute a LEASE AGREEMENT between the LIVERPOOL CENTRAL SCHOOL DISTRICT and the TOWN OF CLAY with regards to the use of the school’s facilities for the Town’s Athletic Sports Programs for the current year which shall extend from June 29, 2015 to August 31, 2015, at a cost of approximately $2,598.25. Motion was seconded by Councilor Rowley.

R15-88 Street Lights(A) - Blackeyed Susan Path:

Councilor Weaver moved the adoption of a resolution authorizing the installation one

(1) 100w high pressure fixture to be installed on a sixteen foot (16’) fiberglass embedded pole using a 100w fixture to help supply additional illumination to Blackeyed Susan Path. The estimated annual cost for the underground lighting fixture is $319.09. Motion was seconded by Councilor Bick.

REGULAR MEETING OF THE TOWN BOARD – May 18th, 2015 Town of Clay

4 R15-89 Traffic & Vehicles (Stop Sign)CPH – Dell Center Drive, Rivers Pointe Way and Laser Drive:

Councilor Young moved the adoption of a resolution calling a public hearing June 1,

2015, commencing at 7:38 P.M., local time to consider the amendment of CHAPTER 211, TRAFFIC AND VEHICLES ORDINANCE of the Code of the Town of Clay,

SECTION 211-12 “STOP INTERSECTIONS,” SCHEDULE IX (§211-42), of the

Town of Clay Municipal Code to designate and provide for ONE (1) STOP SIGN to be installed on the northwest corner of DELL CENTER DRIVE where it intersects with RIVERS POINTE WAY and LASER DRIVE; and the installation of the necessary sign therefore. Motion was seconded by Councilor Weaver.

Ayes - 6 and Noes – 0. Motion passed.

R15-90 Special Permit(CPH) – Town Board Case # 1079 - BANK of AMERICA:

Councilor Young moved the adoption of a resolution calling a public hearing June 1,

2015, commencing at 7:41 P.M., local time to consider the application of BANK OF AMERICA FOR A SPECIAL PERMIT pursuant to Section 230-15B (2) [4] of the Town Code to allow for a Drive-up ATM Kiosk on vacant land located on State Route 31, Tax Map No. 053.-01-20.1, between the railroad tracks and Lowe’s. Motion was seconded by Councilor Weaver.

Ayes - 6 and Noes – 0. Motion passed.

R15-91 Special Permit(CPH) – Town Board Case # 1080- BRIAN’S TOWING:

Councilor Rowley moved the adoption of a resolution calling a public hearing June 15,

2015, commencing at 7:38 P.M., local time to consider the application of BRIAN’S TOWING AND GARY SPRING FOR SPECIAL PERMIT pursuant to Section 230- 17C (2) (e) [7] of the Town Code to allow for motor vehicle storage on property located at 7707 Henry Clay Boulevard, Tax Map No. 087.-01-46.1; currently zoned I-1 industrial. Motion was seconded by Councilor Bray.

Ayes - 6 and Noes – 0. Motion passed.
