At the Regular Meeting of the Town Board, Town of Clay, Onondaga County, held at the Town Hall, Clay, New York on the 8th of September, 2010 at 7:30 P.M., there were:

The meeting was called to order by Deputy Supervisor Edick at 7:30 P.M. All
present joined in the Pledge of Allegiance.
Approval of Minutes:
Councilor Bick moved the adoption of a resolution approving the Minutes of the
Regular Town Board Meeting held on August 16, 2010. Motion was seconded by Councilor Bray.
Ayes-5 and Noes-0. Motion carried.
CANCELLATION AND/OR REQUESTED ADJOURNMENTS:
Deputy Supervisor Edick stated that the resolution for the bid award of the GPS Contract will be adjourned.
Kevin Stott, of Precision Global Tracking, asked if the resolution was adjourned so that the board would have more time to review the results. Deputy Supervisor Edick stated that it was.
Councilor Johnson moved the adoption of a resolution that the application of MC DONALD’S
USA, LLC, and WEGMANS ENTERPRISES, INC. for a SPECIAL PERMIT TO OPERATE TWO DRIVE-IN SERVICES (Drive-Thru) at Mc Donald’s Restaurant located at 7505 Oswego Road, being part of Tax Map No. 093.-04-08.2, pursuant to Section 230-16 C.
REGULAR MEETING OF THE TOWN BOARD - September 8, 2010 Town of Clay
Special Permit (SEQR) - Town Board Case # 1018 - MC DONALD’S USA, LLC, and WEGMANS ENTERPRISES, INC:
(2)(e)[2] of the Code of the Town of Clay, is an unlisted action with a completed EAF and involves no other permit granting agency outside the Town. The proposed project will not have a significant effect on the environment and therefore does not require the preparation of an EIS. Motion was seconded by Councilor Bick.
Ayes-5 and Noes-0. Motion carried.
Special Permit (A) - Town Board Case # 1018 - MC DONALD’S USA, LLC, and WEGMANS ENTERPRISES, INC:
Councilor Johnson moved the adoption of a resolution approving the application of MC
DONALD’S USA, LLC, and WEGMANS ENTERPRISES, INC. for a SPECIAL PERMIT TO OPERATE TWO DRIVE-IN SERVICES (Drive-Thru) at Mc Donald’s Restaurant located at 7505 Oswego Road, being part of Tax Map No. 093.-04-08.2, pursuant to Section 230-16 C. (2)(e)[2] of the Code of the Town of Clay. Motion was seconded by Councilor Bray.

Councilor Bray moved the adoption of a resolution authorizing the advertisement of bids for
RECYCLABLES FOR CLAY REFUSE DISTRICT NO. 1 within the Town of Clay. Said Bids to be received until September 30th, 2010, at 11:00 A.M., local time. Motion was seconded by Councilor Rycraft.

Councilor Bray moved the adoption of a resolution authorizing the advertisement of bids for
DISTRICT NOS. 2, 3, AND 4 within the Town of Clay. Said Bids to be received until September 30th, 2010 at 11:00 A.M., local time. Motion was seconded by Councilor Rycraft.

Councilor Bray moved the adoption of a resolution authorizing the advertisement of bids for
DISTRICT NOS. 5, 7 AND 8 within the Town of Clay. Said bids to be received until REGULAR MEETING OF THE TOWN BOARD - September 8, 2010 Town of Clay September 30th, 2010 at 11:00 A.M., local time. Motion was seconded by Councilor Rycraft.

Zone Change (CPH) - Town Board Case # 1020 COR VERPLANK ROAD COMPANY, LLC:
Councilor Bick moved the adoption of a resolution calling a public hearing October 4th, 2010
commencing at 7:35 P.M., local time, to consider the application of COR VERPLANK ROAD COMPANY, LLC, for a change of zone from RA-100 RESIDENTIAL AGRICULTURAL DISTRICT to RESIDENTIAL R-15 DISTRICT, Tax Map No. 021.-01-2.3 consisting of 77.19± acres of land and Tax Map No. 021.-01-03.4 and also consisting of 10.88 from R-APT DISTRICT to RESIDENTIAL R-15- DISTRICT, part of Tax Map No. 021.-01-2.3 on property located at 3950 Ver Plank Road. Motion was seconded by Councilor Bray.
Ayes-4 and Noes-1. Councilor Johnson stated that he was voting no as he is
opposed to more development in this area, and feels that the Board has the right not to accept an application.
Motion carried.
The meeting was adjourned at 8:46 P.M. upon motion by Councilor Bray and seconded by Councilor Bick. Ayes-5 and Noes-0. Motion carried.
